💡 Flexible working requests are set to change and so is the risk for employers.

Flexible working is already a day one right to request, but from 2027, expectations on employers will increase under the Employment Rights Act. Decisions will need to follow a statutory process, meaning they’ll need to be clearly evidenced, reasonable and consistently applied.

If requests rise, so does scrutiny. Without clear, structured processes, it becomes harder to demonstrate that similar requests are being handled fairly across teams, roles and managers.

This is where proximity bias becomes a real risk. When visibility shapes judgement, decisions on flexibility, progression and performance can quickly become inconsistent - and difficult to defend.

The organisations getting ahead are putting structure around decision-making, including clear criteria for managers, consistent processes, and visibility across outcomes to ensure fairness is built in.
