Local Government Reorganisation: what should developers and landowners be watching?

The Government has announced a review and pause of its Local Government Reorganisation (LGR) programme, following updated legal advice.

The proposals would see many areas move from the current two-tier system of county and district councils to fewer, larger unitary authorities, changing how local government is structured and where responsibilities sit.

For those involved in planning, development and property, this could have implications for planning responsibilities, policy and decision-making.

For our clients across Cambridgeshire, Peterborough, Norfolk and Lincolnshire, the position at time of publish is:

• Cambridgeshire & Peterborough – plans are paused and under review.
• Norfolk – the previous reorganisation decision has been withdrawn.
• Lincolnshire – the decision made in July is also now subject to the Government’s review and the process is paused.

For now, existing councils remain responsible for planning and projects can continue. However, the changing landscape is something developers and landowners should keep in mind when making longer-term planning and investment decisions.

We’ll continue to monitor developments and share relevant updates as the picture becomes clearer.

Building Safety Levy: One month to go

From 1 October 2026, the new Building Safety Levy will apply to certain residential developments in England.

For developers and landowners with schemes in the pipeline, now is the time to understand whether the levy could affect your project — and whether it has been properly allowed for in your viability, programme and development costs.

A few things to check now:

▫️ Is your scheme within scope? Certain developments are exempt, so the first step is understanding how the rules apply to your project.

▫️ When will your building control application be submitted? The timing of the application can be important when determining whether the levy applies.

▫️ Is your site previously developed land? Recent amendments have changed the provisions around previously developed land, including a potential 50% reduction in the levy for qualifying schemes.

▫️ Have the costs been factored into your appraisal? The levy sits alongside existing development charges and should be considered as part of your overall development budget.

With the 1 October 2026 implementation date now just one month away, it's worth reviewing schemes that are currently being designed, submitted or prepared for building control.

Could your land be worth a second look?

The new National Planning Policy Framework (NPPF) puts a stronger focus on delivering new homes and making better use of land — including clearer national policy support for limited infilling within groups of houses. SCROLL for key points...

For landowners, this could be relevant to plots between existing homes, larger gardens, paddocks or other underused land within an established pattern of development.

Importantly, this doesn't mean every infill site will now be suitable for development. Site context, design and local planning policies will still matter, alongside issues such as highways, flooding, ecology, trees, heritage and neighbouring properties.

But for sites that have previously been considered unsuitable — or proposals that haven't succeeded in the past — the planning position may now be worth reassessing.

Progress on site at Clenchwarton

We’re pleased to see this five-dwelling development taking shape for our client, JJ Sandberg Construction Ltd .

Set alongside the Grade II* listed St Margaret’s Church, the scheme has been carefully designed to respond sensitively to its historic setting. The layout centres around a private driveway, creating clear views towards the church, while the low-rise chalet-style dwellings help keep the development’s overall height and visual impact to a minimum.

The details are really starting to come together on site too — including the estate fencing, which helps define the development and gives the scheme a more established, finished appearance as works progress.

With generous gardens, considered landscaping and the retention of the existing trees along the eastern boundary, the development is designed to sit comfortably within its surroundings while providing five high-quality new homes.

New National Planning Policy Framework (NPPF) released — and effective now.

One of the key updates from the 17 August release, is a clearer national policy approach to development outside established settlements, which could create new opportunities for sites previously considered unsuitable.

Double Class Q approval secured in rural Norfolk.

We're pleased to have secured two Class Q approvals providing for the conversion of three existing agricultural barns into four new homes.

The first approval will see two neighbouring barns converted to create a three-bedroom and a two-bedroom dwelling, while the second allows the third barn to be divided into a further three-bedroom and two-bedroom home.

Class Q provides a route for the residential reuse of qualifying agricultural buildings through permitted development, subject to a number of specific prior approval requirements.

For this rural Norfolk site, the proposals provide an opportunity to give three underused agricultural buildings a new lease of life, transforming them into four new homes while making efficient use of an existing rural site.

A great result for our client and another example of how understanding the opportunities within existing rural buildings can help unlock their potential.

BNG changes are now in effect.

From 6 August 2026, new Biodiversity Net Gain (BNG) regulations have introduced changes including:
🔹 A new exemption for developments of 0.2 hectares or less
🔹 A temporary development exemption in certain circumstances
🔹 Greater flexibility for some minor developments
🔹 The removal of the self-build exemption

There are also new monitoring fee requirements that could affect planning applications submitted from today.
