Monday morning – a few interesting facts and statistics…

The trade union legal landscape has officially shifted. Employment tribunal cases have increased substantially from 8% to 30%. Businesses with gaps in their HR strategies will be exposed and could face immediate legal action.

Compounding this, on July 30th, ACAS launched a consultation on a new statutory Code of Practice for disciplinary and grievance. Misalignment with this primary guidance creates a major compliance risk.

Furthermore, a strict two-tier fine system will apply to trade union right of access breaches by late October 2026:

• Up to £75,000 for initial breaches.
• Up to £150,000 for repeated breaches.
