Social media screening sits in a difficult place for most UK employers. They know candidates have online footprints that might be relevant. They also know that looking at those footprints informally can create serious discrimination risk.

So most organisations either do it informally and inconsistently or avoid it entirely. Both approaches leave you exposed.

Every employment screening process generates sensitive personal data. Criminal record information. Financial history. References. And most organisations collect and store it without fully understanding what UK GDPR requires.

Consent must be specific to each check and obtained before any check is run. Privacy notices must cover the full scope of what you are doing. Data retention policies must define how long you keep screening records and when you delete them. Subject access requests must be handled correctly and within the legal timeframe.

The Data Use and Access Act 2025 has introduced additional obligations that many organisations are not yet aware of.

Five years of employment history. Most screening standards require it. Most organisations ask for it. Very few verify it in a way that would satisfy an auditor.

There is a significant difference between asking a candidate for their employment history and actually verifying that what they have told you is accurate. References, gap investigation, documentation of what you found and what decision you made.

I saw organisations fail BS7858 audits not because they had not asked the right questions but because they had not documented their verification process. A reference accepted without checking it was genuine. A gap explained by the candidate but never corroborated.
