The Employment Rights Act changes are continuing. What’s next for employers?

With several important changes approaching, now is the time to make sure your business is prepared.

📅 1 October 2026 - Most Employment Tribunal claim time limits increase from 3 to 6 months.

📅 30 October 2026 - New requirements around preventing sexual harassment, third-party harassment and trade union rights come into effect.

📅 January 2027 - Further changes are expected, including new unfair dismissal and fire and rehire protections.
The message for employers is simple: don’t wait for the deadlines to start preparing.

Understanding what’s coming now gives you time to review your policies, processes and management practices before they need to change.

October will bring another wave of employment law changes. Is your business ready?

From 1 October, the time limit for most Employment Tribunal claims will increase from three to six months.

Then, from 30 October, further changes are due around preventing workplace harassment, third-party harassment and trade union rights.

For employers, September is the time to get ahead- not wait until the new requirements are already in force.

☀️ One week until the summer bank holiday. Is your business prepared?

Before the long weekend, it’s worth checking the basics:
✓ Staffing and holiday cover
✓ Customer communications
✓ Emergency contacts
✓ Contract wording
✓ Holiday pay and entitlement

Remember, employees don’t automatically have a right to paid leave on a bank holiday - entitlement depends on their contract and overall holiday entitlement.

A quick check now can help avoid unnecessary issues later.

👉 Save this checklist and run through it before Friday.

Performance management shouldn’t start when something goes wrong.

Done well, it’s an ongoing conversation that gives employees clarity, helps managers address challenges early and keeps individual goals aligned with the wider business.

Regular one-to-ones, clear objectives and consistent feedback can make a real difference- not only to performance, but to engagement, development and retention.

So, is your performance management process helping your people succeed, or has it become a once-a-year exercise?

Our latest blog explores what effective performance management looks like and why getting it right matters.

Another Employment Rights Act change comes into effect this month.

From 25 August 2026, trade unions will be able to use electronic voting for statutory ballots, with workplace balloting also permitted for industrial action ballots.

For many employers, this may not require immediate action. However, it’s an important development to be aware of, particularly for organisations that recognise or engage with trade unions.

It also forms part of the wider programme of employment law reform being introduced over the coming months.

At MAD-HR, we’ll continue to keep employers informed as the changes take effect, focusing on what they mean in practice and when businesses need to act.

If you’re unsure how the Employment Rights Act changes could affect your organisation, our team is here to help.
