What does "last employed in agriculture" actually mean?

We are pleased to report that it does not mean the job you had before your current one.

Despite years of accepted logic, a case officer in a recent application wanted to created a new basis for assessing the breach of an occupancy condition.

Thankfully applied her usual collaborative approach, drawing on evidence from multiple sources to demonstrate that the condition is breached when the occupant is no longer employed in agriculture.

We’re pleased to share that the correct interpretation was ultimately accepted, and permission was granted for a certificate of lawfulness. This confirmed that the condition had been breached for over 10 years, making it unenforceable.

Redundant farmstead or lawful commercial site?

At first glance, the site in the image below might look like a collection of dilapidated farm buildings. However, we’re delighted to share that we have successfully demonstrated its lawful commercial status—unlocking its potential for redevelopment and continued business use.

We’ve just secured planning permission for the replacement of three buildings with a brand-new commercial workshop, delivering nearly 20,000sqft of new floorspace to become the future home of WS Transportation Ltd.

This has been a real team effort, with Ben Kettle, Adam Mustafa, and Ben Wharfe working together to evidence the commercial use and shape the redevelopment plans.

With approval from Cheshire East Council, this project paves the way for significant investment, job creation, and a major boost to the local rural economy—a fantastic outcome for both the site and the wider community.

It is notoriously difficult to secure planning permission for forestry buildings using permitted development rights, but Adam Mustafa has done it! 🙌

Through expertise and perseverance, Adam overcame the challenges of legislation, planning policy, and local perceptions to deliver approval for a new building that will support a thriving forestry business in Cheshire.

Securing the Future of Higher Oak Farm: Planning Success for Rare Breed Poultry

We’re thrilled to share that we’ve secured planning permission for a permanent agricultural worker’s dwelling on the family-run Higher Oak Farm in Warrington Borough Council.

This small but innovative farm specialises in rare breed poultry, producing and processing everything from eggs to honey, and selling directly to customers. Despite the urban-centric nature of the council, which made justifying the need for this development more complex, our team demonstrated the value and necessity of this project for the farm’s future.

A big congratulations to Ben Kettle, who led the team at Wharfe Rural Planning to achieve this fantastic result.
