We often get asked by clients if we can write the notice period for resignation and termination as just one month either side and we say no for a number of reasons.

1. There is a legal requirement for the employer to provide one week notice per year of service up to a maximum or 12 weeks. This notice must be paid when you end employment, other than in the case of a summary dismissal (in the event of gross misconduct). So whilst the initial terms of notice can be one month either side, once an employee has been with you 5 years, they are entitled to receive more than one months' notice

2. An employer can chose options for new employees such as reduced notice in probationary period i.e. one week

3. No notice is required if an employee has worked for less than one month.

Notice periods can be written to support the commercial reality of businesses and award loyalty of service by employees.
