IMPORTANT UPDATE

On 2 June 2026, the Supreme Court changed how deprivation of liberty is identified in homecare, supported living and community settings. The change took immediate effect. Continuous supervision and control, together with not being free to leave, are no longer enough on their own. Providers must consider the person’s overall circumstances, including the restrictions imposed, their impact, the person’s wishes and objections, and the normality of their living arrangements. Deprivation of liberty can still occur at home. Where it does, authorisation will usually be required from the Court of Protection, as the statutory DoLS process applies only to care homes and hospitals.
