📌 The Cabinet Office has recently announced a new timeline for the implementation of a new regime, with a planned "go-live" date in October 2024. This comes after a six-month preparation period and a delay from the previous target of early 2024.

🧐 The first consultation, which focuses on the secondary legislation needed to put the new regime into effect, including calculations and additional definitions, has been released and will be open for feedback until July 28, 2023. The second consultation, which will cover transparency provision notices, is set to begin in July.

👉 Although the go-live date has been postponed once again, businesses are advised to familiarize themselves with the upcoming changes and start preparing for the new rules that will be implemented.

Creation of a National Security Unit for Procurement: A dedicated team will be established within the Cabinet Office to focus on national security concerns related to procurement. This unit will be responsible for conducting investigations into suppliers who may pose a risk to the country's security and potentially ban them from procurement processes.

✍️ Enhanced Authority to Exclude Suppliers from Specific Sectors: The proposed amendments also grant the government additional powers to ban suppliers from specific sectors, particularly those related to defense and national security, to safeguard sensitive area. The objective of the bill is to encourage the inclusion of social value in the decision-making process of procurement. It mandates that contracting authorities consider environmental sustainability, impact on the local community, and fair treatment of workers when planning.

One way in which this social value criterion is being promoted is by ranking tenders based on the "most advantageous tender" (MAT) approach, rather than the "most economically advantageous tender" (MEAT) approach.

This means that contracting authorities will be required to consider social value factors along with value for money when evaluating tenders.

🧐 As well as making it easier for SMEs to bid for work, the new bill will make it easier to exclude some suppliers completely. That includes those who have previously underperformed on contracts through the use of a “debarment register” that all public sector organisations can view.

👉 “The bill will also strengthen the government’s ability to exclude suppliers from bidding for work if there’s evidence of modern slavery in their supply chain, both in the UK or overseas,” a Cabinet Office spokesperson said.

🧐 A new Procurement Policy Note (PPN 04/23) titled 'Procuring Steel in Government Contracts' has been released by the Cabinet Office. It has replaced PPN 11/16 with immediate effect.

📒 On schedule, the new Italian procurement code (legislative decree 36/2023) was published in the Official Gazette on 31 March 2023.

🧐 The code will apply to all new proceedings starting from 1 April 2023, while the repeal of Legislative Decree 50/2016 is expected from 1 July 2023 and the application of the new legislation also to all proceedings already in progress.
