So can an employer dismiss you for refusing to put a work app on your personal phone?
Well, it comes down to a multitude of factors including:

Did you agree to initially?
How intrusive is the app?
Is it a reasonable request?
Whats the justification?
Are there GDPR/data protection concerns?
Can they provide a work device?
Are there any other methods to meet the objective?
And more...

Can you leave work if its too hot? Well, the main consideration is your health and safety. If you feel you're in imminent or serious risk of danger, let your employer know it's unsafe to work and they should take measures to protect your health and safety.

If they can't, or won't, an employee may decide to refuse to work (depending on the situation), or an employer may send an employee home.

I met my match here 😂 someone else who's as passionate about employnent law as me! Big thanks to Abs!

So, sick pay is now payable from day 1 of absence. Lower earners are eligible too.

And is referring to unfair dismissal which changes in January 2027 to a 6 month qualifying period. That means that anyone employed with the same employer from 1st July to January 2027 will have unfair dismissal rights come January 2027.

Do employers have to pay for eye tests or glasses for staff?

If an employee uses display screen equipment (DSE) as part of their work, employers may have legal duties to fund eye tests and, where glasses are needed solely for DSE use, contribute towards the cost of those glasses.

Unless agreed otherwise -
Generally workers request annual leave. Employers get to approve or deny requests.

There are notice periods relevant
to both parties.

However, an employer should not unreasonably deny annual leave requests. They should also ensure any decision is non-discrminatory.

Do you think that's fair? An employee can go on holiday whilst remaining on sick leave, depending on the circumstances.

Does it annoy you when colleagues go for smoking breaks? Let me know in the comments...

In respect of the twenty minute break mentioned - that's typically for employees over 18 not exempt from WTR, not drivers etc.

But there isn't a legal right for additional breaks on top of a statutory minimum, for smoking. Contracts/other agreements can provide additional.

Has this happened/is this happening to you? Let's discuss it in the comments.
Quiet firing is typically where an employer will make an employee's working life worse in an attempt to get them to leave, reducing their legal risk compared to dismissing them.

You can't jump straight to a disciplinary. You need to investigate first. Always. Not only to comply with the ACAS code but also to prevent legal and financial risk.

What is the biggest misconception people have about the new Fair Work Agency?

That is the question I asked Matthew Taylor, Chair of the Fair Work Agency.

Thank you for your time Matthew.
