The proposed Employment Rights Bill is set to bring some of the most significant workplace reforms we’ve seen in years.

While much of the conversation is focused on general employment law, there’s an important crossover that sponsor licence holders shouldn’t overlook.

Sponsored workers are employees first - which means changes such as:

• Day 1 employment rights
• Enhanced dismissal protections
• Stronger flexible working provisions
• Increased scrutiny on fair process

…will all sit alongside existing sponsor compliance duties.

For organisations sponsoring overseas talent, this creates a dual compliance landscape - immigration + employment law - that must operate hand in hand.

Now is a good time to sense-check:

✔️ Contracts
✔️ Probation processes
✔️ Absence monitoring
✔️ Record-keeping frameworks

ClearPath will be keeping a close eye on how the Bill progresses and what it means operationally for sponsors.

Clarity in people processes supports compliance in immigration.

📢 UK Immigration is going fully digital - are you ready?

From February 2026, major changes are coming to how people travel to the UK, prove immigration status, and stay compliant.

This isn’t just a tech update. It’s a fundamental shift in how the Home Office operates.

🔹 ETA enforcement at the border
🔹 eVisas replacing physical visa vignettes
🔹 Digital Certificates of Entitlement
🔹 Digital Records of Exemption
🔹 Automated checks by airlines and employers

👉 What this means in practice:
Compliance now depends on systems, records and evidence - not explanations or paperwork.

If passport details aren’t linked, accounts aren’t set up correctly, or checks aren’t understood, the risks are real:

✖️ Denied boarding
✖️ Delays at the border
✖️ Sponsor and employer compliance issues

💡 Need help navigating the shift to digital immigration? ClearPath HR & Compliance can help you get it right - calmly, correctly, and audit-ready.

📊 Sponsor compliance isn’t about saying the right thing. It’s about being able to prove it.

The Home Office audits run on:

✔️ Evidence
✔️ Records
✔️ Systems

Not explanations.

Let’s build compliance that survives an audit - not just a conversation.

“We’ll wait until Q2 to think about sponsorship”

Don’t wait ❌

January is when the Home Office, HR teams, and compliance systems reset.
Delaying sponsorship planning until Q2 often means rushed decisions, missed timelines, and avoidable compliance risk.

The strongest sponsor licences are built early, not reactively - with workforce planning, role mapping, and compliance structures in place before hiring pressure kicks in.

January is not too early. It’s the smart starting point.

“We’ll sort sponsor licence compliance later in the year”

Not advised ❌

January is often when:

✅ Roles quietly change
✅ Key people travel or relocate
✅ Reporting responsibilities shift

Those changes still matter to UKVI - even if you’re not sponsoring anyone right now.

What starts as a “we’ll deal with it later” issue in January
is often what shows up months later during audits, reviews, or refusals.

January isn’t a pause month for sponsor compliance.
It’s a setup month.

“January is a quiet month for sponsor licence compliance”

In reality, sponsor duties apply every day of the year ❌

Reporting deadlines, Authorising Officer responsibilities, record-keeping and SMS accuracy don’t pause in January - even if businesses do.

Many compliance issues flagged later in the year can be traced back to gaps created in January.

A quiet diary does not mean reduced risk.

"Nothing happens at the Home Office in January"

Not quite ❌

While some teams may move more slowly, Home Office processing, sponsor licence decision-making, and compliance activity do not stop just because it’s January.

We regularly see refusals, queries and requests for further information issued in January - often catching businesses off guard.

January is not a pause button. It’s a month where preparation and accuracy matter more than ever.

⚠️ Potentially not - and there is a significant compliance risk.

If an Authorising Officer (AO) is permanently overseas, the sponsor licence may no longer meet Home Office expectations for effective oversight and governance.

Sponsor licence compliance requires ongoing control, availability, and accountability, exercised from within the UK. While limited travel is permissible, long-term or indefinite overseas residence can raise serious concerns during audits or compliance visits.

This is a common gap we see as businesses grow and key personnel become more internationally mobile.

👉 If your AO is overseas, it’s important to review your arrangements and ensure compliant oversight is in place. Drop us a message to discuss your options.
