So nothing can go wrong.

Except... when it can. A negative leaving experience will dramatically increase the likelihood of someone attempting to seek legal action towards you, even on relatively tenuous grounds.

£8.5k cost is the average spend employers will have to spend defending against a claim. That's for your solicitors, the drain on your resources litigating, the lack of productivity from you and the team... it all racks up.

So even if you have been a perfect wee angel, an unexpected tribunal claim could still nip you in the bum.

In August 2021, a survey conducted bu FreeAgent – who provide accounting software for small businesses and accountants – more than half of UK SME owners polled said they have experienced burnout since the start of the pandemic in 2020. Let's put those numbers across the UK SME sector, this equates to around 2.9 million business owners across the UK suffering from burnout.

For what? For why?

You're not going to be of use to anyone if you keep pushing. Everyone has a well of mental resilience, and you don't want your cup to runneth dry. Neither do your clients.

OK, so, we hear you. It's because of how our employment law works.

A policy doesn't just exist for funsies. They play a key role in supporting fairness and consistency across an organisation, as well as potentially helping to protect the organisation against legal claims.

Legal claims here is the key. Inconsistent employment practices are what are more likely to land you in hot water with a tribunal board in the UK.

The most common jurisdictional complaint disposed of (as in completed and resolved, not just whacked out) between January to March 2021 as released by the MOJ was ‘Unfair dismissal’ which is a far-reaching term. It's not just about the reasons, it's about HOW a company goes about the dismissal.

All it takes is one employee to be dismissed incorrectly, even with the best reasons behind it, and you risk legal action. And with the average disposal time currently running at 50+ weeks... do you really have time for that?

Our top tip for Friday... when someone's coming back to work after being off sick, make sure you do the following;

1) discuss if they need their workload reduced or duties adjusted to ease the transition back
2) conduct a thorough return to work meeting
3) make sure they know you're there for them and you're glad they're back
4) share any resources your company has for those returning to work
5) schedule in a check-in point during their first week back... someone can think everything is fine and need to adjust it.

Do you know how much money is estimated to be lost to poor mental health sick days from the UK in 2021?

According to Bloomberg in an article published on 13th December 2021, it shot up to £43 BILLION.

A 31% increase.

Unless your managers are trained to spot the signs, you're risking the health and welfare of your staff, and jeopardising the efficiency of your business.
