A recent Planning Appeals Commission decision highlights a key difference from England and Wales: digging a trench alone is not considered a material commencement of a permission in Northern Ireland. For developments involving building er****on, construction work starts with pouring concrete into the trench.

Takeaway: To ensure compliance, dig the trench AND pour the concrete within the time limit. Be sure to document this process!
