Further to my last post on the subject, this has just been received fron Southampton MO

The Merchant Shipping (Safety Standards for Passenger Ships on Domestic Voyages) regulation 2022 (also known as “Grandfather Rights”) were signed by the Minister on the 7th December 2022 and came into force on the 29th December 2022.

The two-year phase in starts from that date (29th December 2022) and operators must have vessels compliant by the first survey from 29th December 2024.

Please note:
These regulations and notices apply to Class III-VIa vessels and do not apply to any vessels certified against MSN1823.
Changes to the vessels can be started now and involve the Marine Office where necessary.
Please submit any applications for exemptions (temporary or permanent) early so there is time for this to be reviewed by Survey Branch and amendments can made to the submission (where needed) prior to approval and work being undertaken. Please note that the MCAs target time is to reply within 30 working days for applications for exemptions. For each amendment or further submission the clock is reset.
Surveyor resource within the marine office is not unlimited so I would like to ask for your cooperation in starting this process early to ensure all surveys and plan approvals can be completed in time.

New rules which will bring the safety of older passenger ships in line with modern standards fit for the 21st century are now in force for the UK.

The Merchant Shipping (Safety Standards for Passenger Ships on Domestic Voyages) (Miscellaneous Amendments) Regulations 2022 (“Grandfather Rights”) were signed by the Minister on 07 December 2022, and will come into force on 29 December 2022. The two year phase-in period will run from that date, which means that operators will need to bring relevant vessels into compliance by the first survey from the 29 December 2024.

We can undertake a Gap Analysis on your vessels to determine the extent that you’ll be affected on a case by case basis. Grandfather Rights - The Reveiw of Standards for Existing Vessels.

Announcement by the MCA

In accordance with paragraphs 13-15 of Schedule 8 of the European Union (Withdrawal) Act 2018, a Written Ministerial Statement relating to the draft “Grandfather Rights” legislation was laid on 21 March. This marks the beginning of a 28 day publication period of the draft Regulations to both Houses of parliament. The 28 day pre-publication period is extended by periods during which parliament are in recess, so actually does not end until mid-May, due to there being recess periods during April and May.

After the end of the 28 day publication period, the Regulations will pass through some additional administrative steps in advance of the Regulations themselves being laid in parliament, which is expected to happen in July.

We know from past experience that nothing is set in stone, but this means that the legislation could come into force before the end of the third quarter of this calendar year (July to September 2022)”. There will be a phase-in period of two years from the coming into force date of the Regulations, and vessels will need to be in compliance with any new requirements relevant to them by the first survey after the two year period has ended.

Invitation to the Meeting of the
Passenger Vessel Operators Association 27 November 2020 @ 10:00

We would like to invite bona fide passenger boat operators and other genuine organisations with a proven record of actively assisting the industry, to the PVOA meeting on 27 November at 10:00. This meeting will be online, using Microsoft Teams.

The aims of the PVOA are:

To ensure that we represent our members in a suitable manner whilst continuing to gain recognition from the regulators and other bodies that might affect our industry? We address this with a proactive approach , engaging with the regulator.

To work together to promote safer standards both at Sea and on Inland Waterways

The Chairman and / or Vice Chairman, attend DPSSG and industry working groups.

Historically our normal bi-annual meeting take place in Southampton and consist of the Chairman giving a report on DPSSG, Working Groups, Current Consultations and other issues affecting the industry. We normally have representation from the Maritime and Coastguard Agency.

Membership of the PVOA is currently £45 per year, subject review by paid up members.

This meeting is open to both members and non members, who we would hope would consider to join.
