⚠️ The “Joint Account Trap”…

With the Market @ The Shed this Sunday, I wanted to clear up one of the most common things I hear:

👉 “We’ve got a joint bank account, so we’re covered.”

Unfortunately, this isn’t always the case.

If one person loses mental capacity and there is no Lasting Power of Attorney (LPA) in place, banks can restrict or even freeze access to protect the vulnerable person.

➡️ This can leave the other partner struggling to pay bills, mortgage, or even day-to-day expenses.

❗ The 3 most common misunderstandings:

1️⃣ “We have a joint account, so the money is safe.”

❌ Access can still be restricted without an LPA.

2️⃣ “My next of kin can make decisions for me.”

❌ In reality, “next of kin” has very little legal authority.

3️⃣ “I already have a Will.”

❌ A Will only applies after death —
👉 an LPA protects you while you’re still here.

⚠️ Important: Once capacity is lost, it’s too late to put an LPA in place.

Families can then face a long and costly process through the Court of Protection.

🧠 A question I’m being asked a lot is ...

Following the discussion about Lasting Powers of Attorney on the Martin Lewis Money Show, a number of people have asked me:

“Do I only need an LPA when I’m older?”
The answer is no.

LPAs are actually most important while you are still fit and well, because they allow you to choose who can help manage things if something unexpected happens.

Without an LPA, even close family members may not be able to deal with things like:

• managing bank accounts
• paying bills
• speaking to doctors
• making care decisions

Many people also assume a joint bank account solves the problem, but this is not always the case. If someone loses mental capacity, banks can sometimes restrict accounts until proper authority is in place.
