A personal trainer has been awarded close to £150,000 after raising a health and safety concern during fitness testing linked to a Ministry of Defence contract.

After flagging that a participant should not have continued due to unsafe blood pressure levels, the tribunal found her treatment changed significantly. This included issues with pay, rota changes, and disciplinary action.

It ruled that her constructive dismissal was automatically unfair, concluding that her protected disclosure materially influenced how she was treated.

She was awarded £76,740 in compensation, including loss of wages and benefits between 2023 and 2026, £37,000 for injury to feelings, and a 10% uplift for failure to follow the Acas guidance on disciplinary proceedings.

The company must also pay more than £22,000 in tax payable on the award, along with unpaid statutory sick and holiday pay.

In case you missed it...📰

An employment tribunal has ruled that Nestlé unfairly dismissed long-serving employee Luke Billings after a workplace va**ng incident triggered a factory fire alarm.

Despite finding there were reasonable grounds to believe Mr Billings had vaped in the toilets, the tribunal concluded that dismissal was not a reasonable response.

The key issue was that the decision was driven by his failure to admit fault, which the judge made clear is not misconduct in itself.

The ruling also highlighted:
- A lack of clear policy stating va**ng would be treated as gross misconduct
- Failure to properly consider his 10+ years of unblemished service
- The incident being a one-off, rather than a pattern of behaviour

Billings was awarded £22,216.72, half the total award because of his contributory conduct.

A reminder that even where misconduct is suspected, employers must ensure their disciplinary decisions are proportionate, consistent, and clearly supported by policy.

The government has launched a consultation on the use of NDAs in workplace harassment and discrimination cases, aiming to prevent misuse and strengthen protections for workers.

The review will look at when NDAs should still be allowed, who individuals can speak to if they are in place, and whether the rules should be extended to cover self-employed people.

This follows confirmation last year that the Employment Rights Act, which received Royal Assent before Christmas, will ban employers from using NDAs to “gag” workers who have experienced harassment or discrimination.

If you’re considering summary dismissal, make sure you:

An employment tribunal has awarded over £23,500 after repeated derogatory comments about an employee’s Irish heritage were ruled to be racial harassment.

The judgment found the behaviour created a hostile and offensive working environment.

West Leeds Civils were ordered to pay the employee £13,000 for injury to feelings, and £6,000 for financial loss (plus interest) for harassment related to race and victimisation. An additional award of £2,800 was made for West Leeds Civils’ failure to provide a written statement of terms and conditions of employment.
