New Anti-Discrimination Provisions Have Taken Effect in Wales

From 1 June 2026, new anti-discrimination provisions linked to the Renters’ Rights Act 2025 have taken effect in Wales, through amendments to the Renting Homes (Wales) Act 2016 and Renting Homes (Fees etc.) (Wales) Act 2019.

It will now be unlawful for landlords, or anyone acting on their behalf to discriminate against applicants because they have children or receive benefits. This includes refusing enquiries, viewings, access to property information, granting occupation contracts, allowing children to live at or visit the dwelling, or because a contract-holder receives benefits during the occupation.

All new occupation contracts must now contain these new fundamental terms banning rental discrimination. In addition, a written statement of these new rights must also be given to existing contract-holders no later than 14 June 2026, clearly indicating where these new terms should sit within their existing occupation contract written.

How Landlords Decide What Is Wear and Tear or Damage

At the end of the tenancy, for a landlord to establish a proper claim for damage and reduce risks associated with disputes under tenancy deposit protection rules, it’s important to understand and be able to differentiate between damage or acceptable wear and tear. In most cases a landlord will not be able to claim new for old, which would be considered betterment (the tenant was not required to return the property “like new”).

The TDS website (https://www.tenancydepositscheme.com/) has a useful depreciation guide and using this, alongside a good inventory and checkout process, can assist what can be challenging situations. Wear and tear is about how long it should last with reasonable use.

Live Webinar: Beyond “Lifestyle”: Managing Damp and Mould Legally and Proactively

The way damp and mould complaints are handled has fundamentally changed. Following updated Government guidance, increased local authority enforcement activity, and the Renters’ Rights reforms, letting agents are now firmly on the front line of compliance risk.

Councils now have the power to move straight to formal enforcement action, risking Improvement Notices and substantial financial penalties being issued much earlier in the process - often without the informal warning stages many agents and landlords previously expected. At the same time, the “tenant lifestyle” defence is rapidly disappearing as a standalone response.

This essential webinar will help letting agents understand:
- Their legal and practical responsibilities
- How to proactively manage damp and mould risks
- What local authorities now expect from landlords and agents
- How to properly respond to tenant complaints
- When vulnerability changes the urgency of a case
- How to document actions to protect the agency
- The risks of poor advice, delay, or inadequate inspections

With the Renters’ Rights Act now in force, it’s vital to understand what impact this new legislation has on our established processes throughout the tenancy journey. This webinar focuses on understanding how to secure commitment between the landlord and the tenant to start a tenancy at some point in the future in a Renters’ Rights Act, Renting Homes (Wales) Act and Tenant Fees Act compliant manner.

This webinar will help agents to formulate their pre-tenancy procedure:

- Ensure actions are in the best interests of the landlord
- The benefits of using an agreement to lease
- Do we want to request a holding deposit?
- What agents should provide before the signing of an agreement to lease
- When is the appropriate time to seek commitment

A Tenant Requesting an Emotional Support Animal (ESA)

One of the biggest misunderstandings for letting agents is the difference between an emotional support animal and an actual assistance or support dog. In the UK, an emotional support animal - often called an ESA - is usually still treated legally as a pet. Even if the animal helps someone emotionally or mentally, that alone does not automatically give it special legal status, so normal pet permission rules generally still apply.

A trained assistance or psychiatric support dog is different. These dogs are trained to perform specific tasks linked to a person’s disability, which can bring the Equality Act 2010 into play. In those cases, landlords and agents should consider reasonable adjustments and avoid blanket refusals. The key question is not simply whether the tenant benefits emotionally, but whether the dog is a trained disability aid rather than companionship alone.

Understanding the Information Sheet

There are 17 days to the Statement day.

For all tenancies in force over the transition to the new rules on the 1 May, if the tenancy is wholly or partly in writing, the landlord or agent will be required to provide the “information sheet” to the tenant by the end of May. The Government has provided this information already. It just has to be given to the tenant.

Access PDF version of The Renters’ Rights Act Information Sheet 2026 here -https://assets.publishing.service.gov.uk/media/69bc04b8f7b1c24d8e23ce60/The_Renters__Rights_Act_Information_Sheet_2026.pdf

Note the requirement to give a landlord copy even if the agent gives a copy. Note too that if you have served a section 8 or 21 notice before the 1 May the tenancy remains assured shorthold and the Information Sheet is not needed till the one month period after the tenancy ceases to be an assured shorthold. If a tenancy is purely verbal, then you will need to give a statement, giving more information, including names of parties, addresses, property details etc.
