As of Monday 16th August 2021, employees who are double jabbed or under the age of 18 will no longer be required to isolate should they be contacted by NHS Test and Trace for being in close contact with an individual who has tested positive for COVID-19.
Employees who are double jabbed must have received their second COVID-19 vaccine at least 14 days before being contacted by NHS Test and Trace. Within this 14 day period, they will still have to isolate.

Under 18s are no longer required to isolate should they be in close contact with an individual who has tested positive for COVID-19.

Both double jabbed individuals and individuals under the age of 18 are strongly advised to take a PCR test upon being contacted by NHS Track and Trace, as well as take other precautions such as wearing masks in enclosed spaces and limiting contact with others.

The NHS Test and Trace app will now take into consideration an individual’s vaccination status as well as age when contacting them to notify their close contact with a positive person and the steps required to be taken.

Forcing an employee to return to their normal workplace who is immunosuppressed or has Long Covid and are regarded as disabled could result in a claim for disability discrimination if reasonable adjustments are not considered and implemented where possible. A reasonable adjustment is likely to include working from home – particularly if this arrangement has worked well during the last 18 months or so.

It is early days regarding the long term effects of COVID but Long Covid (in some cases) could amount to a disability where there is “a physical or mental impairment that has a ‘substantial’ and ‘long-term’ negative effect on a person’s ability to do normal daily activities”.
