Important updates for UK employers ❗
From 6 April 2026, all UK employers, are legally required to keep detailed, adequate records of their workers' annual leave and holiday pay.
The new duty has been introduced under the Employment Rights Act 2025, and applies to all employees and workers - including those with irregular hours or part-year contracts.
Key requirements:
➖ Mandatory Record-Keeping: Employers must record ordinary and additional annual leave, leave carried forward from previous years, and details of holiday pay, including which pay elements (e.g., overtime, commission) are included or excluded.
➖ Record Retention: Records must be retained for a minimum of six years from the date they are created.
➖ Enforcement & Penalties: The new Fair Work Agency (FWA), which launches on 7 April 2026, will be responsible for enforcing these rules. Failure to keep adequate records will be a criminal offence, potentially leading to unlimited fines.
➖ Format: While no specific format is mandated, records must be sufficient to demonstrate compliance with Working Time Regulations.
