Delighted to have a tricky debt collection job brought to conclusion. Debtor's director continually insisted that they could not afford to pay, would agree to pay in installments, some paid others missed. He just couldn't get his head around the consequences of trading whilst insolvent.

The debt was over two years old and for two years it has been the same old story to the client "can't afford to pay, will pay tomorrow, next week, next month" tomorrow, next week, next month then became the following day/week/month.

In the end, I was recommended to the client and obtained the vast majority of the debt in 6 weeks. We looked at issuing a winding up petition and I told the debtor we were going down this route but, the worry was that as the debtor (if its director is to be believed) was indebted to HMRC and they might support the petition and ultimately take it over.

I would have preferred everything to be paid but, given the debtor's situation it's a good result and the client is happy as half a loaf is better than no loaf or in this case, 96% of the debt is better than nothing.

I hate to admit on a public forum that my standards are slipping but, I feel I must.

A Debt with interest and costs collected in 3 working days whereas I think my best result is an hour but, this became a tricky one and an excellent reminder of not to push your luck!

The debtor insisted they were not paying because they had not seen a report confirming that work was completed to spec. The client insisted that they were not providing it as they would not get paid.

I had a look at the client's terms of business which included a clause limiting the time a dispute could be raised and also that no report would be provided until the invoice was paid.

The terms also included a clause in respect of interest and compensation wich was in excess of what I claimed under The late payment of commercial debts (interest) act. So I told the debtor of said clauses and the debt was now higher, they had agreed to t&cs etc. They tried to raise a a dispute that had already been resolved.

I told them pay up or I start escalating it. They ended up paying the higher amount. I suspect that they never read the client terms of business and got caught out.

To be fair, I said as soon as payment is made I will send the report as I was holding it ready to send when payment was made. Payment made, report sent, no need for court action which they invited us to start. Now they can go and try and get payment from their client which I suspect was the reason for not paying in the first place.

Client suitably compensated for late payment and hopefully the debtor will learn a leason and pay their debts on time in the future.

I have just had to review East Fife Joinery on https://willtheypay.co.uk/ I had given various warnings that I would do so, I have tried to come to an amicable solution whereby they just pay what they owe but, it would appear that has not been possible.

I don't take these actions lightly but, other potential suppliers need to be aware of credit risk before granting credit and that's the whole point of the reviewing platform.

Just for balance, I will be happy to update the review when / if we come to an agreement regardless of how unlikely that seems.

Well, after an eventful week I am looking forward to a stress free weekend with a bit of the world cup which will also be stress free as it looks like I Scotland won't be there for me to stress over there performances. (can we call them performances ?)

2 very different debts and debtors during the week, both in the troublesome construction industry and both companies balance sheet insolvent yet a positive outcome in both cases.

1 very troublesome that required a LOT of attention and they discovered that I don't like it when they don't respond. I actually got accused of stalking them as I kept contacting them and they simply couldn't understand that I would not have been annoying them if they paid their debt in the first instance. Anyway, 10k debt, interest and compensation paid so it cost them more in the end. First invoice paid in 2 working days from the first contact and debt cleared on 5th working day from first contact.

2nd one, I was seriously concerned about as balance sheet insolvent, court judgment against them and other unpaid creditors. (Including HMRC) We agreed a payment plan backed by a director's personal guarantee but, I was still worried that (still am tbh) that the company might go under. So the client offered to waive interest and costs for a 53% payment on account and remaining balance in 2 weeks. The debt is over 1 year old. Payment received 2 working days from the first contact.

This one was conducted very different from the first one, the director contacted me straight away, was amicable, apologetic and wanted to come to an agreement. We did come to agreement, a payment has been made and I am confident the remainder will be paid.

Both client's came as the results of recommendations from my other contacts.

Time to take a breath and reflect on what could have been for Scotland if they were better, could score goals and did not give away silly goals 😁🏴󠁧󠁢󠁳󠁣󠁴󠁿
