Update on European Commission's New Regulation on Microplastics
The European Commission has shared its latest insights and additional information regarding the implementation of the new law on microplastics. This regulation, known as Commission Regulation (EU) 2023/2055, was published by the European Union in September 2023 to restrict synthetic polymer microparticles ('microplastics').
Key points to note:
•The law will be implemented in phases starting from October 17, 2023.
•Plastic glitter is considered a mixture under REACH and falls within the scope of the restriction.
•Only specific types and uses of glitter are affected, depending on composition, use, and whether they are loose, trapped, or attached to objects.
•Non-biodegradable, insoluble plastic glitter is covered by the restriction, while biodegradable, soluble, natural, or inorganic glitter is not considered microplastics.
•The sale ban on non-biodegradable, insoluble plastic glitter applies to certain uses without transitional periods, such as art and crafts, toys, and textiles (with certain exceptions).
•Loose plastic glitter without transitional periods is prohibited unless it is biodegradable, soluble, trapped in a solid matrix, solid films, solid objects, or completely contained.
•The sale ban also applies to glittered decorative objects where glitter detaches during normal use, such as Christmas decorations or party hats.
•The classification of glitter affixed to an article depends on whether glitter is an integral part of the article or not.
•Products containing plastic glitter for uses other than those specified in the regulation can continue to be sold if they were placed on the market before October 17, 2023.
