What if reporting shows a pay gap of more than 5%?

Under the EU Pay Transparency Directive, if a gender pay gap above 5% cannot be justified by objective, gender-neutral criteria, companies may need to carry out a joint pay assessment with workers’ representatives.

And that is only one of the risks of non-compliance.

The transposition deadline for the Directive is 7 June 2026. The new rules reinforce equal pay for employees of all genders and require employers to prove they do not breach equal-pay and pay-transparency obligations.

Non-compliance may expose companies to financial penalties, compensation claims from employees affected by gender pay discrimination, and higher litigation risks due to the shift in the burden of proof to the employer.
