Are you aware of how the DPC assesses a breach?

Once a breach notification is lodged with the Data Protection Commission, multiple factors are assessed. These include, but are by no means limited to:

1. The nature of the breach: was it intentionally or accidentally caused?
2. Whether there is a history of breaches of a similar nature
3. Characteristics and volume of the personal data involved
4. Categorisation of the data subjects: e.g., are they children / vulnerable persons?
5. The statutory responsibilities of the data controller and/or processor

The GDPR requires that, where an organisation which is not established in the EU offers goods and services to individuals in the EU or monitors their behaviour, the organisation should designate an EU Rep, subject to certain exceptions.

The EU Rep should act on behalf of the organisation and is the point of contact for any supervisory authority & individuals on all issues related to the processing of personal data of those individuals.
