There is a lot of confusion regarding gratuity eligibility after the introduction of the new labour provisions. Here’s a simple clarification every employer, HR professional, contractor, and employee should understand:

Completion of 1 year for gratuity eligibility is applicable only for Contractual / Fixed-Term Contract Workers
It is NOT applicable to regular permanent employees

For regular employees, the gratuity eligibility remains 5 years of continuous service under the Payment of Gratuity provisions.
