10 interesting facts about Litigation

Here are 10 interesting facts concerning WTO litigation generally and U.S. – China litigation in the WTO.

1. Only about 1/3 of all cases filed in the WTO actually result in full litigation. (For the U.S. it’s a bit higher.)
2. The U.S. has been a respondent more often than a complainant in the WTO.
3. The U.S. has won about the same number of cases it has lost in the WTO.
4. China has brought more cases against the U.S. than it has against any other country.
5. The U.S. has won all its decided cases against China that it bought as a complainant.
6. China has won three cases against the U.S.
7. The Bush and Obama administrations brought about the same number of cases against China.
8. The Bush administration brought about twice as many total cases in the WTO as has the Obama administration.
9. The Clinton administration has brought about five times the cases in the WTO as has the Obama administration.
10. The total number of cases filed in the WTO from 1997-2011 has declined about 80%.

Actions to be taken on personal injury

Whatever you are intending to do about your personal injury, actions you could take include:-

inform the police if, for example, the injury resulted from a road accident
if the injury resulted from a road accident, report it to your insurance company. The insurance policy may be invalid if an accident is not reported
report the injury to your doctor because it could become more serious. You should do this even if the injury seems minor. If you subsequently go to court to get compensation for the injury, the doctor will be asked to provide a medical report
gather evidence about the accident and injuries. For example, it may be useful to take photographs of the scene of an accident and of what caused the injury. You should also, if possible, write an account of the incident while details are still fresh in your mind. If there are witnesses, you should make a note of their names and addresses

1. When are the changes to the personal-injury system likely to take place?

While the changes have been pushed back once already, it is likely that their implementation will be seen in April 2013. It's not entirely beyond the realms of possibility that further delays will be seen.

2. If I lose, will my attempts to get compensated have cost me money?

If you have launched your personal injury claim prior to April of 2013 then you should still be able to benefit from the 'no-win no fee' system. This means that the claim will not cost you anything. After April 2013, it will have cost you money to claim.

3. Does my case qualify to receive financial help via the Legal Aid Bill?

Personal injury cases are not on the Legal Aid Bill (this is the main reason why the no win no fee system was introduced in the first instance) and so it is highly unlikely that you will be able to receive financial help this description.

4. Will I still be able to use the small claims court?

At this stage, there are no plans to abolish the small claims court and the amounts which can be claimed by the system may be increased, making it more accessible for injured claimants seeking recompense.

5. Why is the government making additional risk for the personally injured?

The government is responding to media pressure surrounding the compensation culture and that it's seeking to raise the risk of launching this type of legal case in order to reduce the amount of claims compensating people from injuries being made in the UK.

6. When are the decisions about the proposed changes likely to be finalised?

At this stage, it is unknown as to when we will see the final stages of the proposed changes. While the government has deadlines to meet, it needs to ensure that decisions are made correctly.
