₹34 Crore Mall ITC Denied? ஒரு “OR” மாற்றிய GST Result!

Owner’s own office construction-க்கு இந்த ruling-ஐ straightaway apply செய்யக்கூடாது.

Tax Audit: Who Needs It, What Changes Now

Tax audit limit for FY 2025-26: ₹1 crore or ₹10 crore? And does F&O trading count?

Most business owners and traders get the 44AB turnover test wrong in the same two places.

1. The cash test. Your limit is ₹1 crore — it becomes ₹10 crore only if cash receipts AND cash payments are both under 5%. One test, two conditions. Miss it and you've skipped an audit you needed.

2. F&O turnover. Your broker dashboard shows contract turnover in crores. That is NOT 44AB turnover. As per the ICAI Guidance Note, F&O turnover = the sum of absolute profit and loss on each trade. Option sale premium is no longer added separately. ₹4 crore of Nifty contracts with ₹3 lakh of absolute P&L = ₹3 lakh turnover.

That correction alone moves most retail traders out of audit — with zero change to the tax they owe.

Inside this carousel:
→ Turnover limits for business, profession, 44AD and 44ADA
→ Applicability by class of person — individual, firm, LLP, company, trust, NRI
→ F&O and intraday turnover computation with a worked example
→ Form 3CA vs 3CB, and the due dates
→ The 8 Form 3CD clauses under the scanner after Notification 23/2025
→ A full tax audit checklist and what s.271B non-compliance costs

Audit report due 30 Sep 2026. Audited ITR due 31 Oct 2026.

Send this to whoever handles your books — before September.

Which ITR Form Should You File for AY 2026-27? ITR-1 vs ITR-2 vs ITR-3 vs ITR-4 Explained ✅

Wrong ITR form = defective return notice u/s 139(9) — and your refund gets stuck. 😬
Here's your 30-second guide:
📌 ITR-1 (Sahaj) → Salaried, income up to ₹50L, 1–2 house properties — Due 31 July
📌 ITR-2 → Capital gains, foreign assets, income above ₹50L, no business — Due 31 July
📌 ITR-3 → Business, profession, F&O traders, partners — Due 31 August
📌 ITR-4 (Sugam) → Presumptive income u/s 44AD / 44ADA / 44AE — Due 31 August
⚡ NEW this year: ITR-3 & ITR-4 (non-audit) get one extra month — 31 Aug 2026 under Finance Act 2026.
⚠️ Company director or holding unlisted shares? ITR-1 is NOT for you.
Still confused which form fits your income? Drop a "ITR" in the comments or DM us — we file it right, the first time. 📩

Tax paid ✅ Interest paid ✅ Penalty still ₹7 lakh+ 😳

A salaried employee. Two employers in one year. Switched to
the old regime. Filed without CA help.

He accepted every addition. Paid every rupee the AO asked.
Cooperated at every stage.

And still got hit with a 200% penalty under Section 270A —
labelled "misreporting." No limb-wise finding. No analysis.
Just a stamp.

Here's what we did 👇

🔍 Re-audited the Department's own computation
⚡ Found exempt income they had taxed (s.10(10AA), s.16(iii))
📋 Caught a ₹91,700 excess — demand higher than the order itself
🏠 Identified s.24(b) home-loan interest they never allowed
⚖️ Filed Form 35 appeal + stay + s.154 refund + s.273A waiver

The law is clear:
→ s.270A(6)(a): Bona fide explanation + full disclosure = NO penalty
→ Delhi HC (Prem Brothers, 2022): No limb named = manifestly arbitrary
→ SC (Reliance Petroproducts): A wrong claim is not a crime

The 200% penalty? Still being dismantled.

If you got a notice — 143(2), 148, 270A, 143(3) — don't reply
in panic. The 30-day window is strict. One wrong admission
can cost lakhs.

Tax kattunaalum. Interest kattunaalum.
Penalty order still came. ₹7 lakh+. 😳

This is Section 270A.
And most people don't know how to fight it.

Here's what actually happened 👇

✅ Tax paid in full
✅ Interest paid
✅ Every addition accepted
✅ Cooperated at every hearing

Still → 200% penalty. "Misreporting."
No limb named. No analysis. Just a stamp.

We re-read their own computation.
They had taxed EXEMPT income.
Demand was higher than their own order.
A deduction they never even gave.

Swipe to see the full defence — and the errors
we found in the Department's own file.

Nobody tells salaried employees this about
Section 270A penalty. So we will. 👇
