FSSAI has notified the Draft FSS (Labelling & Display) Amendment Regulations, 2022 related to labelling requirements of Non-retail container, minimally processed products, tolerance limit, legible / audible warning statement related to pan masala etc.
The draft notification specifically states the labelling requirement for non-retail containers mainly in B2B market among other requirements.
These draft notification would require the non-retailer containers to display manufacturing details which were earlier not standardized.

Do you know the difference between proprietary food and Novel food? Are your ingredients and food product as per FSSAI standards?

If not, then you have to apply for product approval under FSS (Approval for Non-Specified Food & Food Ingredients) Regulations, 2017 before manufacturing and offering your product for sale to consumers, failure to which may lead to a minimum of imprisonment for a term which may extend to six months and also with fine which may extend to one lakh rupees.

FSSAI has re-operationalized the FSS (Licensing & Registration of Food Businesses) Amendment Regulation, 2021 wef 11-11-2022.

These regulations were approved by the Food Authority in 2017 & they have been operationalized since then vide direction from the authority.

The FBOs still follow the requirement under the FSS (Licensing & Regulation of Food Businesses) Regulation, 2011 and are not updated.

Labeling packaged food products is a tedious task as multiple regulations need to be considered while designing a label, failure to which may lead to notice from the authority for misbranding & mislabelling.

Pure, Natural, Original, Genuine, Authentic, Real, Fresh - these words might look the same but have a different meanings when claimed on your food product labels.

Additionally nutritional claims such as high in protein, low in sodium, fat-free etc should also meet the requirements as laid down in the FSS (Advertising & claims) Regulation, 2022.

These claims form an important part of the label and the marketing strategy and hence should meet the regulatory requirements. Besides failure to do this may lead to a notice from the FSO or in general may create unnecessary fuss on social media.

DO YOU KNOW? FSSAI has operationalized the FSSAI Nutra Regulation, 2022, thus superseding the FSS (Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for Special Medical Purpose and Prebiotic and Probiotic Food), Regulations, 2022.

This transaction requires the FBO to reevaluate their existing compositions to ensure that they comply with the requirements of the FSS Nutra Regulation 2022, failure to which creates hurdles in the modification & renewal of the FSSAI licenses along with other complaince issue.

As per the FSS (Labelling & Display) Regulation, 2020, the Food Service Establishment having a central license or outlets at 10 or more locations shall mention the calorific value, nutritional info, allergen declaration and other mandatory info on their menu.

The FBO has to submit an annual return to FSSAI by 31st May of each year, failure to which attracts a penalty of Rs 100/day till the submission of the annual return. This results in hefty amounts and a huge burden on the FBOs.
As per the latest order of the FSSAI, "Any delay in filing return beyond 31st May of each year shall attract a penalty of Rs 100/day for delay till the date of filing the return. The maximum penalty that can be levied shall not exceed 5 times the annual fees". This will come into the effect from FY 2021-22 onwards.
