Bombay High Court has refused interim relief to a same-sex couple challenging the gift tax provisions under Section 56(2)(x) of the Income-tax Act, 1961.
Since Indian law does not legally recognise same-sex partners as “spouses”, the exemption available for gifts received from a spouse is not applicable.
The Court noted that the term “spouse” must be interpreted strictly as per existing marriage laws. As a result, gifts received from same-sex partners continue to be taxable, and taxpayers may also face Income Tax Notices in cases of non-disclosure or high-value transfers.
This judgment highlights a significant gap in tax law and reinforces the need for careful tax planning, documentation, and compliance for individuals in same-sex relationships.

DGGI Delhi Busts ₹645 Crore Fake ITC Racket - Key Operator Arrested
The Directorate General of GST Intelligence ( ), Delhi Zonal Unit, has uncovered a major GST fraud involving fraudulent Input Tax Credit ( ) of about ₹645 crore. The scam was run through 229 dummy GST-registered firms, all controlled by a Delhi-based network.
During search operations across Delhi, officers found strong evidence such as incriminating documents, digital data, ledgers, 162 mobile phones, 44 digital signatures, and over 200 cheque books—all linked to fake firms created only for issuing bills without actual supply of goods or services.
The investigation has identified Mukesh Sharma as the main operator behind the scam. He allegedly managed GST registrations, banking operations and movement of funds across multiple bogus entities. Since the offences are cognizable and non-bailable, he was arrested on 11.11.2025 under Sections 132(1)(b) & 132(1)(c) of the CGST Act, 2017, and sent to judicial custody.
DGGI has also found indications of money laundering, where the proceeds were routed through an NGO and even a political outfit. Further investigation is in progress.
