A PoSH policy on paper is only the beginning. What truly matters is what happens when a complaint is actually filed.

Courts, regulators, and employees look beyond the policy document. They look at how the organisation responded, how promptly it acted, whether due process was followed, and whether everyone involved was treated with fairness and dignity.

The TCS Nashik case was not just a headline. It was a mirror.

It showed what happens when complaints go unheard, when internal mechanisms exist only on paper, and when leadership fails to act. Maharashtra has since directed stricter enforcement of the PoSH Act across all establishments with 10 or more employees.

The real question for organisations is not:

“Could this happen here?”

The Government of India is reviewing the POSH Act.
SHLC’s voice is in that room.
Aparajita Amar- Advocate, Certified Sexual Harassment and Workplace Diversity Advisor, and Founder of SHLC, was invited by the National Commission for Women, Government of India as a Resource Person for the National Consultation on the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

Held on 18th July 2026 at Vigyan Bhawan, New Delhi, the consultation brought together more than 100 legal experts and stakeholders from across the country, to identify gaps in the existing law and propose amendments to the POSH Act and Rules.

Aparajita contributed her expert inputs toward the final recommendations that will inform how India’s primary workplace safety law evolves.

We recently had the opportunity to conduct a PoSH and POCSO awareness session at  Bangalore, with coaches associated with .

The session focused on real coaching situations involving professional boundaries, communication with athletes, safeguarding responsibilities, and athlete safety — particularly while working with minors and young athletes.
The discussions around boundaries, accountability, and everyday coaching practices ending in meaningful resolutions.

Safe sporting environments are built not only through policy, but also through everyday decisions, awareness, and consistent professional conduct.

A prior consensual relationship does not simplify an Internal Committee’s job. It complicates it.
Picture this scenario: A consensual workplace relationship ends in a complaint of sexual harassment.
Now the IC must analyse both- without presumption and without moral framing.
Does prior consent become legally irrelevant?
Is power dynamics a factor of assessment?
If one party influenced reporting lines or appraisals, does that alter the threshold?
Was the relationship disclosed under any internal policy?

If not, does that indicate a governance gap?
The Internal Committee must apply statutory standards, procedural fairness, and evidentiary discipline- even when the facts are emotionally charged.

That balancing exercise requires structured reasoning.

We work through complexities like this in the SHLC PoSH Train-the-Trainer Programme, with a focus on strengthening capacity for IC members.

Most PoSH awareness sessions begin in a predictable way.
The law is explained. The policy is outlined. The procedures are clear. And then the questions start.
If you conduct PoSH awareness sessions, which moment do you find hardest to navigate?

• The room starts agreeing that women often file false complaints
• A participant insists the behaviour described “doesn’t really count” as harassment
• Someone shares a real workplace incident during the session
• Participants dismiss a scenario by saying “it was just a joke”
These are the moments when a training session shifts. The conversation moves away from slides and into real workplace attitudes.
Handling that shift thoughtfully is often the hardest part of PoSH training.

We’ll share insights from the responses later this week.
