Key Notice Period & Separation Rules (As of 2026):
Final Settlement Deadline:
Companies must complete the full and final settlement, including salary, bonus, and leave encashment, within two working days of an employee's separation (resignation, dismissal, or termination). Contractual Supremacy: The duration of the notice period is primarily determined by the employment contract, typically ranging between 30 to 90 days, and the new codes do not introduce a blanket statutory period for all. Salary in Lieu: If a company terminates an employee immediately, they must provide salary in lieu of the notice period."Workmen's Protections: Under the Industrial Relations Code, "workmen" (defined as non-supervisory staff) are entitled to one month's notice or wages in lieu if terminated (retrenched).
