Last few days left to avoid GST Penalty for late filing

The biggest relief extended to small business by the 31st GST Council is the waiver of late fee for filing GSTR-1, GSTR-3B and GSTR-4 return for the period July 2017 to September 2018.

The 31st GST Council has earlier announced:

“Late fee shall be completely waived for all taxpayers in case FORM GSTR-1, FORM GSTR-3B &FORM GSTR-4 for the months / quarters July, 2017 to September, 2018, are furnished after 22.12.2018 but on or before 31.03.2019.”

Thus, filing any overdue GST Return upto September 2018 - before 31st March 2019 will not attract any late fee penalty.

From 1st April 2019, heavy GST penalty will be applicable for filing these overdue returns. Hence, we request you to kindly take note of this provision to file all overdue GST returns.

Note: GST return has to be filed by all persons having GST registration - even if there is no transaction. In case there is no transaction, NIL GST return has to be filed or late filing penalty would be applicable.

The Annual return under GST (FORM GSTR-9) is active on the GST portal now.

Key points:

1. Annual return in Form GSTR-9 once filed cannot be revised.
2. Annual return in form GSTR-9 is required to be filed by every taxpayer registered as normal taxpayer (including those with nil returns) during the relevant financial year.

1. Individual taxpayers with annual income up to 5 lakh rupees to get full tax rebate. Individuals with gross income up to 6.5 lakh rupees will not need to pay any tax if they make investments in provident funds and prescribed equities. Around 3 crore middle class taxpayers will get tax exemption due to this measure.
2. Standard tax deduction for salaried persons raised from 40,000 rupees to 50,000 rupees
3. TDS threshold on interest on bank and post office deposits raised from 10,000 to 40,000 rupees.
4. TDS threshold on rental income raised from 1.8 lakh to 2.4 lakh rupees.
5. Benefit of rollover of capital tax gains to be increased from investment in one residential house to that in two residential houses, for a taxpayer having capital gains up to 2 crore rupees; can be exercised once in a lifetime.
