**TRADEMARK REGISTRATION: PROTECTING YOUR BRAND AND BUSINESS IDENTITY**
A brand name, logo, tagline or distinctive business identity can become a valuable intellectual property asset of a business. However, merely using a brand name does not necessarily provide the same level of legal protection as obtaining trademark registration.
# # # What is a Trademark?
A Trademark is a distinctive mark capable of identifying and distinguishing the goods or services of one person or business from those of others.
A trademark may include, among other things:
• Brand / Business Name
• Product Name
• Logo or Device
• Word Mark
• Tagline or Slogan
• Label or Combination of distinctive elements
# # # Why Should You Register Your Trademark?
Trademark registration provides several important commercial and legal advantages:
✔️ Establishes statutory rights in the registered mark
✔️ Strengthens protection against unauthorised use of identical or deceptively similar marks
✔️ Helps establish ownership and goodwill associated with the brand
✔️ Enables the registered proprietor to take appropriate legal action against infringement
✔️ Enhances the value of the brand as an intangible business asset
✔️ Supports licensing, franchising and other commercialisation opportunities
✔️ Provides protection for a period of 10 years, renewable indefinitely subject to applicable law
# # # Can a Trademark Name Be “Reserved”?
There is no separate mechanism under the Trade Marks Act for permanently reserving a brand name.
However, filing a trademark application provides an official filing date and application number. A trademark application may also be filed on a **“Proposed to be Used”** basis where the mark has not yet commenced commercial use.
Therefore, conducting a proper trademark search and filing at the appropriate stage can be an important part of a brand protection strategy.
# # # Trademark Registration – Step-by-Step Process
**1. Preliminary Trademark Search**
A search is conducted to identify existing registered, pending and potentially conflicting marks.
**2. Identification of Appropriate Class**
The goods or services for which protection is required are identified under the applicable Trademark Classification.
**3. Assessment of the Mark**
The proposed name, logo or other mark is reviewed for distinctiveness and possible objections.
**4. Preparation of Application**
Applicant details, representation of the mark, goods/services description and other required information are compiled.
**5. Filing of Form TM-A**
The application is electronically filed with the Trade Marks Registry.
**6. Examination by the Registry**
The application is examined on applicable legal and procedural grounds.
**7. Examination Report / Objection – If Any**
Where an objection is raised, an appropriate response is filed within the prescribed timeline and a hearing may be attended, where required.
**8. Advertisement in Trade Marks Journal**
Upon acceptance, the application may proceed to publication in the Trade Marks Journal.
**9. Opposition Period**
Third parties may oppose the application within the prescribed period.
**10. Registration**
Where the application successfully completes the statutory process without a successful opposition, the mark proceeds towards registration and the registration certificate is issued.
# # # Government Filing Fees
**For each mark and each class:**
**Individual / Startup / Small Enterprise:** ₹4,500
**Other Applicants:** ₹9,000
# # # Expedited Trademark Processing
Where expedited processing is available and applicable, the prescribed expedited processing fee is:
**Individual / Startup / Small Enterprise:** ₹20,000 per mark/class
**Other Applicants:** ₹40,000 per mark/class
The expedited processing fee is **in addition to the applicable trademark application fee**.
⚠️ **Important:** Expedited processing facilitates faster processing/examination. It does not guarantee acceptance or registration of the trademark.
