Patents are issued for invention and not for discovery. Genes are present within every human. Isolating a gene from a human doesn’t make that an invention. If that’s the case then removing of liver, heart, pancreas could also be considered patentable

How to patent an idea in USA

INTRODUCTION

The word patent has derived from the Latin word patere which indicates to lay open. It can be said as a set of exclusive rights granted by sovereign state to an inventor or their assignee for a limited period of time, in exchange for public disclosure of invention. The grant of patent to the invention in different countries is based on the national laws and international agreements. Under WTO’s agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) patents should be available in WTO member states for any invention in all fields of technology and the term of protection should be available for a minimum period of 20 years. The article deals with filing of patent application and its procedure in USA. It is granted by the United States Patent and Trademark Office.

Patent Trolls against Amazon, Dell, HP


Patent Troll is a term that describes people or companies which acquires patents with no intention of using them. A lawsuit has been brought by a Texas based company against Amazon, Dell and HP for infringing its patent which describes a method of inserting links into online newspapers and other media.

Patent trolls appear to be flourishing despite repeated calls for Washington to rein them in. The latest evidence includes new lawsuits against Amazon, Dell and HP over a system for inserting links into news articles.
