*How to choose a right External Member for your POSH ICC?*

POSH or SH Act mandates a company to list down the names and designations of ICC members in its POSH policy against sexual harassment. The minimum requirement for a committee is 4 people, of which more than 50% should be women. ICC should have a presiding officer (a senior woman employee), one external member (a third party, who is not attached to the company in any way and is committed to the cause of prevention of sexual harrasment or familiar with the issues pertaining to sexual harassment. The lifespan of an ICC is 3 years, after which new members should be appointed.

A recent judgement by the Delhi HC in Ruchika Singh Chhabra vs M/s AIR France India and Anr. case, asked for reconstitution of ICC based on the 'external member not having relevant experience in dealing with matters of sexual harassment'. The external committee member was a labour lawyer and the court said the person needs to be committed to the cause of women.

*Factors to be considered in choosing ECM:*

Look for someone who is certified in POSH & has relevant experience in setting up POSH compliance from start to finish covering drawing policy, doing training & compliance.

Take a person who has experience in seeing a case through proper investigation and understands everything from the kind of papers needed, conducting meeting & hearings to final report submission.

Look for someone who is gender neutral & at the same time understands the workplace culture. You don’t want someone who fires people for the sake of compliance or based on fabricated evidences with malafide intentions. Spend time with an external member to know if they have any gender biases.

Brownie point is if that person also understand your industry because every industry works differently with its own uniqueness.

He is diagnosed with Kidney Failure (ESRD). It is the last stage of chronic kidney disease.
