करदाता द्वारा ITC नकारे जाने और सेक्शन 74 की कार्यवाही को चुनौती दी गई।

विभाग ने आरोप लगाया कि *वस्तुओं का वास्तविक आवागमन नहीं हुआ और टोल प्लाज़ा रसीदें प्रस्तुत नहीं की गईं।*

न्यायालय ने स्पष्ट किया कि *GST कानून में टोल प्लाज़ा रसीद प्रस्तुत करने की कोई अनिवार्य शर्त नहीं है।*
करदाता ने टैक्स इनवॉइस, ई-वे बिल, बिल्टी, बैंक भुगतान और GSTR-1, 2A, 3B रिकॉर्ड पर रखे थे।
कोर्ट ने माना कि इन दस्तावेजों से वस्तुओं की वास्तविक प्राप्ति सिद्ध होती है।
केवल टोल रसीद न होने के आधार पर ITC नकारना मनमाना और अवैध है।

परिणामस्वरूप, आदेश रद्द किया गए और जमा की गई राशि की वापसी का निर्देश दिया गया

Income Tax Act, 2025: New PAN Rules for Children (Effective 1 April 2026)

The Draft Income Tax Rules, 2026 introduce important compliance updates regarding PAN applications for children born on or after 1 October 2023.

Mandatory Birth Certificate - A valid birth certificate issued by the Municipal Authority or the Indian Consulate will now be required for PAN issuance.

Additional Requirements for NRIs/RNORS - Applicants classified as Non-Residents (NRIs) or Resident but Not Ordinarily Resident (RNORs) must also provide passport details.
