Does Child Maintenance Automatically End at 18? | Chhattisgarh High Court Legal Update
Does a child’s right to maintenance automatically end upon attaining the age of 18?
The Chhattisgarh High Court has recently clarified that, in the case of a child suffering from a physical or mental abnormality or disability and unable to maintain themselves, attaining majority by itself does not automatically end the right to receive maintenance.
In Raghav Lahre v. Bharat Lahre, the Court considered a case involving a child with Autism Spectrum Disorder and Speech Disorder who required continued care and support.
The Court held that age alone cannot be the determining factor. The relevant consideration is whether, after attaining majority, the person is actually capable of maintaining themselves and earning a livelihood.
Accordingly, the Court set aside the condition that maintenance would automatically stop upon attaining majority, while also making clear that the continuation of maintenance depends upon the circumstances and evidence concerning the person's ability to maintain themselves.
