The Delhi government's ambitious proposal to make metro travel free for women came under sharp criticism from the Supreme Court on Friday which questioned it for giving "freebies" and "sops" saying it might lead the Delhi Metro Rail Corporation (DMRC) to losses.

The Delhi government should refrain from giving freebies from "public money", the apex court said and warned that it would stop them from doing so as courts are not "powerless".

"If you will allow people to travel for free, then the Delhi metro may go into loss. If you will give freebies, we will stop you. You are fighting for a cause here and you want them to incur loss. Do not give sops, it is public money," a bench of Justices Arun Mishra and Deepak Gupta told the lawyer appearing for Delhi government.

The Calcutta High Court on Tuesday exonerated a convict from the charge of Murder under Section 302 of IPC, stating that Section 106 of the Indian Evidence Act does not discharge the prosecution from proving its case beyond reasonable doubt and that an accused has the right to silence without being adversely affected by such silence.

Background

The appeal was filed by one Prasanta Biswas who had been sentenced to life term by the Additional Sessions Judge of Ranaghat for murdering his wife. The prosecution's case therein was that the appellant used to torture the victim and must have murdered her in order to pursue his illicit relationship with a lady of his village, Swapna. However, none of those witnesses had seen the appellant mixing with Swapna.

The Bombay High Court has clarified that all licensed restaurants can serve herbal or tobacco-free ho**ah and no action will be taken against them by the police.

Division bench of Justice Ranjit More and Justice NJ Jamadar were hearing a bath of petitions filed by various restaurant owners who claimed to be harassed by police authorities for trying to serve herbal ho**ah at their place after the high court in July allowed Ali Abdi, owner of Sheesha Skylounge to serve herbal ho**ah at all his outlets.

The Supreme Court took note of the 'conflict between increasing number of cars and dwindling availability of land' which had aggravated problem of parking spaces in Delhi. Addressing the same, the court gave out a series of directions to the concerned authorities of the Delhi Government yesterday.

The bench of Justices Arun Mishra and Deepak Gupta said "…we feel there is a need to pass a detailed order on a mundane issue like parking because this may impact town planning. Proper parking policies will also lead to less pollution, less crime and a better and more dignified life which every citizen is entitled to under Article 21 of the Constitution of India" in a petition filed by public interest attorney, M. C. Mehta.

Historically, and also ironically, women under Hindu Law were not entitled to any share in the immovable or movable property either as a daughter or a wife, of their ancestors. However, in some capacities women were given the Right to Inherit property,but the same were only a limited right of enjoyment to the Property.

After India became Independent, the Hindu law relating to property was codified and Hindu Succession Act, 1956 was enacted. It was only by this Act of 1956 that Women's right to property, ie, right to inheritance in a Joint Hindu Family came to be recognised. However, even then a daughter was not made a Coparcener.

It is one thing to say that absence of attestation by a witness having prior knowledge of testator may be picked up as a suspicious circumstance to doubt the genuineness of Will and another thing to say that law does not permit a witness not having prior knowledge of identity of testator to attest a Will.

The Kerala High Court has held that there is no statutory requirement that the attesting witness shall necessarily be one who maintains previous knowledge or acquaintance with the testator/testatrix.
