ELECTIONS=>

 Elections are to be conducted only by State Election Authority as per new model bye-laws. There are two categories of Elections – A) < than 250 Members B) > than 250 Members which needs to be conducted under the guidance and supervision of Hon’ble Registrar. No Election is valid otherwise except where Members strength is below 250. Society can conduct Self Election as per guideline.
 Hon’ble Registrar is to be approached 6 months prior before expiry term of current Managing Committee along with the members details i.e. I Register in digital format.

REDEVELOPMENT/ SELF REDEVELOPMENT=>

 Redevelopment is generally described as New Construction. Over on old Plot, which has a Pre-Existing Structure.(In any housing society)
 It is hot issue today as vacant and Un-Encroached Land is now hardly available to carry out further construction.
 The cost of structural repairs by demolishing and reconstructing such dilapted building is beyond the reach of society.
 This is a prime reason why many societies are willing to opt for redevelopment to acquire ultimate benefits.

ADOPTION OF NEW MODEL BYE-LAWS=>

As per Maharashtra Co-operative Societies (Amendment) Ordinance Act, 2013, New Byelaws is released with following new points:
1. Usually AGM shall be hold on or before 30th September each year under section 75 (1) of Act (except pandemic or any Act of God).
2. Heads for levy of charges
3. No. of Committee Members
4. Audit of Accounts of Society
5. Election
6. Education & Training Fund
7. Active and Non-active members

RECOVERY U/S 154(B) (29)FROM MEMBER (101 RECOVERY)=>
 We All are aware that in each and every society few Non-Paying members are there who enjoy the Uninterrupted Necessary Services without paying maintenance bill.
 As a result there is a huge outstanding is filed up as and interest which needs to be recovered.
 The MC being an honorary body finds it difficult to follow due process of Law to recover the amount due and payable by defaulters for want of time.

CONVEYANCE & DEEMED CONVEYANCE
 Conveyance is a right of each and every society.

 As soon as society is registered it is mandatory upon the builder to handover the Conveyance to the society within 4 months.

 Unfortunately, Despite of such clear cut Law. There was a gross violation because the Managing Committee is unaware about their rights.
