Our Partner, Somdutta Bhattacharyya, shared his insights with Mint on the insolvency framework applicable to personal guarantors under the Insolvency and Bankruptcy Code, 2016, in the context of the recent proceedings concerning Zee Group founder and chairman emeritus Subhash Chandra.

Commenting on the scope of judicial review once a repayment plan has been approved by creditors, Somdutta noted that the National Company Law Tribunal’s role is limited to examining statutory compliance and legality, and does not extend to questioning the commercial wisdom of the committee of creditors or the level of recovery agreed under the plan.

We are pleased to share that our Partner, Soorjya Ganguli, recently participated in a panel discussion on “Interim Relief & Anti-Suit Injunctions – A Resurgent Cross-Border Battle”, as part of the session “The India–Singapore Arbitration Corridor: Emergency Relief, Interim Measures & Cross-Border Challenges”, jointly organised by Mumbai Centre For International Arbitration (MCIA) and Drew & Napier LLC during Singapore Convention Week 2026.

The panel discussed interim relief and anti-suit injunctions in cross-border disputes and the challenges of enforcing interim orders from foreign-seated arbitrations in India.

We are pleased to share that our Partner, Arka Majumdar, has authored an article for Financial Express examining the Supreme Court’s recent nine-judge Bench ruling on the meaning of “industry” and the questions that remain open under India’s new labour law framework.

Arka examines how the Supreme Court’s ruling reaffirms the Bangalore Water Supply & Sewerage Board v. A. Rajappa test for determining what constitutes an “industry” in pending disputes under the Industrial Disputes Act, 1947. He also explains why the ruling does not conclusively settle the position under the Industrial Relations Code, 2020, and highlights the scope for future judicial interpretation of the term “industry” under Section 2(p) of the Code.

Krishnava Dutt shared his insights with Financial Express on the legal position surrounding N Chandrasekaran’s continuation as a director of Tata Sons following the adjournment of the company’s Annual General Meeting for want of quorum.

Krishnava noted, “The adjournment has created a governance impasse, not a vacancy. Since the AGM was inquorate owing to the restrictions placed on SRTT by the Charity Commissioner, Mr Chandrasekaran’s directorship continues pending a validly constituted adjourned AGM.”

He further observed that if the restraint on SRTT continues, Tata Sons may need to seek an extension from the Registrar of Companies or appropriate directions from the National Company Law Tribunal.

India Resurgence Fund (IndiaRF) is a leading India-focused platform dedicated to investing in special situations, owned and managed as a 50:50 joint venture between Piramal Group (Piramal) and Bain Capital’s Special Situations team (Bain Capital).
