Section 16: What is it about ?

Section 16 is a provision under the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023.

It provides the Chief Election Commissioner and Election Commissioners immunity from civil or criminal proceedings for actions taken or statements made in the discharge, or purported discharge, of their official duties.

No court shall initiate or continue any civil or criminal proceedings against a person who is or has served as the Chief Election Commissioner or an Election Commissioner.

A Constitutional Bench is a bench of the Supreme Court consisting of at least five judges, constituted to decide cases involving a substantial question of law as to the interpretation of the Constitution.

Constitutional basis

Article 145(3) of the Constitution provides that such cases must be heard by a bench of at least 5 judges.

In simple words

If a case involves an important question about what the Constitution means or how a constitutional provision should be interpreted, it may be heard by a Constitutional Bench.
