Major Compliance Update: CPCB Finalizes Environmental Compensation Guidelines for Used Oil EPR
The Central Pollution Control Board has officially released FINAL Guidelines for imposition of Environmental Compensation (EC) under the Used Oil EPR framework (2023 Amendment), approved by the Ministry of Environment, Forest and Climate Change.
This is NOT a draft anymore — it is now enforceable.

EC Regime 1 (EPR Target Failure)

CPCB has issued Show Cause Notices (SCNs) to several Producers, Importers & Brand Owners (PIBOs) regarding Plastic EPR compliance for FY 2022-23 under the Environment (Protection) Act, 1986.

📄 GPCB Circular – Bank Guarantee for Hazardous Waste Pre-processing Facilities

🎯 Purpose of the Circular
GPCB has introduced a mandatory Bank Guarantee (BG) requirement for facilities that pre-process hazardous waste before utilization or co-processing.
This step is taken because some incidents have been observed such as:
• Fire accidents at facilities
• Operational shutdowns
• Abandonment of hazardous waste at sites
In such situations, authorities may need immediate funds to safely transport, handle, or dispose of stranded hazardous waste.
The Bank Guarantee acts as a financial safeguard.

⚖️ Legal Framework
These facilities operate under the:
• Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016
The BG does not replace environmental liability.
The Polluter Pays Principle will still apply.

* Up to 25,000 MT/year – ₹50 Lakhs

The latest email being received from CPCB is directing to all registered PIBOs to transfer certificates as per EPR target on CPCB portal for the year 2022-23 and file their annual return on CPCB portal for the year 2022-23 before 31 October, 2023.
