NEW RESTRICTION PROPOSAL: PHT

The World Trade Organization received the draft regulation by European Commission amending REACH on 8 May 2026. The regulation proposes the addition of the very persistent and very bioaccumulative Terphenyl, hydrogenated (or PHT, CAS 61788-32-7) in the Annex XVII of the cited legislation.

The adoption is expected in the fourth quarter of 2026 and would not allow the placing on the market and the use of PHT as a substance on its own or as a component of a mixtures/ articles at concentration of almost 0,1% w/w from 18 months after the coming into force of the regulation (with some exception i.e. civil aircraft application).

Public comments are accepted until 7 July 2026.

MORE CONTROL ON PRODUCTS BY EPA

The U.S. Environmental Protection Agency (EPA) Region 6 office uncovered unregistered and alleged biocides in small retail locations in Texas through inspections over the last months. In particular antimicrobial or disinfectant claims were found on cleaning products. This fact underlines that the conformity with FIFRA (the Federal Insecticide, Fungicide, and Rodenticide Act) remains one major theme to face.

In US, first of all, company’s registration to EPA in needed, then request for pesticide’s registration under FIFRA follows. At this point the use, sale and distribution of the product must satisfy the requirements (regarding for example the labels) and obligations stated by the cited American federal pesticide law. As such, the demonstration of the manufactures that the product will not generally cause unreasonable adverse effects on the environment and human health and the respect of the labelling are requested.

Italy published the National Plan for Official Controls on Biocidal Products

The Italian Ministry of Health published the National Plan for Official Controls on Biocidal Products according to art. 65 paragraph 2 of BPR regulation on 8 April 2026. The coordination of the 2026 control activities on the compliance for biocidal products and treated article with Reg. 528/2012, Reg.1272/2008 and Reg. 1907/2006 remains one of the main goals of the document.

The plan covers the entire management of biocidal products substances and treated articles, including the manufacturing process till the placing on the market. It also promotes the Italian participation to the European Enforcement Projects BEF 1-2-3 (Biocidal En-Force) regarding the inspections, the packaging and labelling of biocidal products.

The document refers to the products subject to the authorisation regime according to the Regulation (EU) No 528/2012, to the products subject to the transitional regime set out in Article 89 of Regulation (EU) No 528/2012, to the treated articles as defined in Article 58 of Regulation (EU) No 528/2012 and to active substances used in the formulation of biocidal products, limited to verification of compliance with Article 95 of Regulation (EU) No 528/2012.

UPDATE ON THE REGISTRATION OF CHEMICAL SUBSTANCES IN TURKEY

Temporary registration for all applicable substances became mandatory in consideration of the communication of the Turkish Ministry of Environment, Urbanization and Climate Change (MoECC) on 4 March 2026.

The presence of a Lead Registrant (LR) for each substance isn’t fundamental anymore for the registration process. In fact, two distinct deadlines were set allowing the completion of temporary registration in compliance with REACH in Turkey (KKDIK):

-31 March 2026 for the LR;

-30 September 2026 for the other registrants through the individual temporary registration via submission on the Chemical Registration System (KKS) with stated justification.

IMPORT OF HAZARDOUS MIXTURES IN SWITZERLAND: WHAT TO EXPECT

According to the article 48 of ChemO (Swiss Chemicals Ordinance) the requirement of UFI (Unique Formula Identifier) is mandatory for hazardous mixtures placed on Swiss market. The obligation applies from 1 January 2026 and within 3 months after the first placement of the mixtures on the market.

The creation of a Swiss UFI with Swiss UFI Generator is necessary in absence of an existing EU generated UFI for mixture imported in Switzerland and classified as dangerous. It must appear on the label (or SDS depending upon the product packaging).

However, if an EU UFI is already present, it can be used both on the label of the product and both in Swiss RPC (Swiss Chemical Products Register). The reporting in RPC is indeed an important specific obligation that companies must face in Switzerland, and it regards all hazardous mixtures for both professional and private use.

UFI is not required for mixtures classified only for environmental hazards; otherwise, it is mandatory if mixtures are classified for physical and human health hazards too.

The obligation reflects on the Swiss- based importers of the non-Swiss companies. They must report to RPC using their main user account.

NEW DECREE CHANGES THE IMPORT IN ARGENTINA

For the first time Argentina will accept sworn declarations of compliance with import and/or salability standards from any of the jurisdictions listed in the corresponding annex of the decree from 15 February 2026 according to Decree 892/2025.

Published on 17 December 2025 in the Official Gazette, it simplifies procedures for international trade unification and interactions with other countries (such as Australia, EFTA, EU, UK, US, Japan and Israel) on the matter of importation of products that require technical or safety certification.

The Argentinian ANMAT (National Administration of Drugs, Food and Medical Technology) and SENASA (National Service of Agri-Food Health and Quality) are the regulators; while cosmetics, household cleaners, personal hygiene products and perfumes which are already complaint with regulations, certifications and standards of handful designated industrialised countries are part of the included goods of the decree.
