⚖️ Important Update on the March 11th Constitutional Court Hearing
On Thursday morning, March 11th, 2026, the long-anticipated Constitutional Court hearing took place in Rome to address the questions on the constitutionality of Citizenship Law 74/2025, the new law that was adopted in the spring of last year, and which drastically changed Jure Sanguinis (blood right) citizenship and has had a sweeping effect on the entire Italian diaspora.
Yesterday evening, the Court released a statement that the new law does not appear to be unconstitutional.
Although the specifics of the decision will not be known until the sentence is issued in a few weeks, it appears that Law 74/2025 is being upheld and that the arguments regarding its unconstitutionality will ultimately be rejected.
What now?
Without the sentence, the details of the court’s decision are not yet known; particularly, what exceptions may exist and how these may affect cases that do not fall within the current limits of blood-right citizenship eligibility (the “two-generation limit”) remain unclear.
Furthermore, another pending Constitutional case will be heard on June 9th, 2026, to challenge the new law, particularly regarding its effect on the transmission of citizenship to minor children.
At this time, those eligible under the new law who have either an Italian-born parent or grandparent who never naturalized are still eligible to request citizenship. However, those who were eligible under the previous laws and had an ancestor more than two generations back are still in limbo until the sentence is released and its contents are known.
Next Steps
Once the sentence is released in its entirety, our careful study of its contents will reveal potential avenues that may be available to those who are currently not eligible under Law 24/2025.
Furthermore, once the Court debates in June on the issues raised by the court of Mantova, specifically regarding the right of citizenship transmission to minors and retroactivity, we will have even more information to work with in finding paths for those currently blocked by the restrictions under the new law.
