⚖️ Important Update on the March 11th Constitutional Court Hearing

On Thursday morning, March 11th, 2026, the long-anticipated Constitutional Court hearing took place in Rome to address the questions on the constitutionality of Citizenship Law 74/2025, the new law that was adopted in the spring of last year, and which drastically changed Jure Sanguinis (blood right) citizenship and has had a sweeping effect on the entire Italian diaspora.

Yesterday evening, the Court released a statement that the new law does not appear to be unconstitutional.

Although the specifics of the decision will not be known until the sentence is issued in a few weeks, it appears that Law 74/2025 is being upheld and that the arguments regarding its unconstitutionality will ultimately be rejected.

What now?

Without the sentence, the details of the court’s decision are not yet known; particularly, what exceptions may exist and how these may affect cases that do not fall within the current limits of blood-right citizenship eligibility (the “two-generation limit”) remain unclear.

Furthermore, another pending Constitutional case will be heard on June 9th, 2026, to challenge the new law, particularly regarding its effect on the transmission of citizenship to minor children.

At this time, those eligible under the new law who have either an Italian-born parent or grandparent who never naturalized are still eligible to request citizenship. However, those who were eligible under the previous laws and had an ancestor more than two generations back are still in limbo until the sentence is released and its contents are known.

Next Steps

Once the sentence is released in its entirety, our careful study of its contents will reveal potential avenues that may be available to those who are currently not eligible under Law 24/2025.

Furthermore, once the Court debates in June on the issues raised by the court of Mantova, specifically regarding the right of citizenship transmission to minors and retroactivity, we will have even more information to work with in finding paths for those currently blocked by the restrictions under the new law.

⏳ We are now only 2 weeks away from the long-anticipated Constitutional Court hearing scheduled to take place in Rome on March 11th, 2026.

It is the hope of hundreds of thousands of Italian-born descendants worldwide that the court will issue a favourable ruling challenging the validity of the recent reforms to Italian Citizenship law. Of particular concern is how the Court's decision may affect the sweeping changes introduced by the Tajani Decree (Decree-Law No. 36/2025, converted into Law No. 74/2025), which, overnight, rendered thousands of people ineligible for Italian citizenship by blood right (Jure Sanguinis).

Under the pre-decree law changes, an Italian descendant could request recognition of Italian Citizenship without any generational limit, provided that other requirements were met (no loss of citizenship before the next-in-line was born, the burden of proof to demonstrate familial links, etc.).

Under the measures adopted by Law No. 74/2025, only those who have a first or second-generation ancestor born in Italy and who NEVER in their lifetime lost their Italian citizenship are eligible under the current legislation. This effectively reduced worldwide eligibility under Jure Sanguinis by 90%, crushing the dreams of thousands who were already preparing their requests for recognition of Italian citizenship.

The Court is set to decide on the many concerns around the New Law's constitutional conformity, particularly, the retroactive impact on persons born before Law No. 74/2025 came into effect in the spring of 2025.

⚖️ The Court is expected to take some time to issue its decision, given the gravity of the situation and the growing public interest in the outcome.

❗️📣 IMPORTANT CITIZENSHIP NEWS -> REGISTER YOUR MINOR CHILD ASAP 📣❗️
❓ What happened: On March 28th, 2025, the Italian Council of Ministers published a Decreto Legge (Decree-Law), which entered into force on the same day. This Decree aimed to limit the right to recognition of Italian Citizenship, with immediate effect, while awaiting the approval by the Chamber of Deputies to pass the law.
On May 23rd, 2025, the Decree was officially converted into Law n. 74, which drastically redefined Italian nationality law through Jure Sanguinis (blood right).
🔍 What changed: Before March 27th, 2025, any person who had an Italian Ancestor who was alive at the time of the Unification of Italy (1861) could be considered for Italian Citizenship, provided some requirements were met.
From March 28th, 2025 onward, applicants are ONLY eligible for Italian Citizenship through bloodright in the case that at least one grandparent OR parent possessed EXCLUSIVELY Italian Citizenship (i.e. no other nationality or dual nationality)
🎯 The impact: The entirety of Italian Nationality law has been uprooted overnight.
We are profoundly disappointed by the adoption of the Decree measures into Law. These changes came without warning and will have enormous, sweeping effects on not only the vast Italian Diaspora but the Nation itself.
⚖️ What happens now?: Despite this jarring news, we remain steadfastly dedicated to our belief that, for those born before March 28th, 2025, the new measures that retroactively apply the Law to anyone born before the Decree of March 28th, 2025, are unconstitutional, and we are arguing this point in our client's appeals.
👩‍👧 "But if I am already a recognized Italian Citizen, how can I make sure my minor child is registered as an Italian under the new legislation?": According to Law n. 74, recognized Italian Citizens (living abroad) will have until midnight of May 31st, 2026, to register their minor child.
🤷‍♂️ How to register your child: It is of the UTMOST importance that you begin the process of registering your minor child with your local Italian consulate ASAP, as the process is complicated and differs consulate to consulate.

🚨 BREAKING NEWS 🚨 regarding the recent legislative changes the Italian Government has decided to adopt concerning citizenship iure sanguinis (blood right).

These changes were enacted using the legislative tool of urgent/emergency decree, i.e. D. Lgs. 36/2025 of March 28, 2025 (“Decree 36”), which entered into force on the same day and was published in the Official Gazette no. 73.

At the outset, we would like to assure you that we are deeply disappointed by this regulatory choice, made through the use of an emergency decree based on an alleged serious and current risk to national security (as of yet undefined).

Together with other colleagues, lawyers, and experts in the field, we are already assessing protest actions, gathering signatures, and raising constitutional doubts about Decree 36 before it is presented to the Italian Parliament (within 60 days) and converted into law.
