Security on Unpaid Tax
Finance Act 2022 has amended has amended by repealing section 40 of The Tax Procedures Act, 2015 and replacing it with the following new section. 40. (1) “where a taxpayer, being the owner of property in Kenya, fails to pay a tax by the due date, the Commissioner may notify the Registrar in writing that the property, to the extent of the taxpayer’s interest in the property, shall be the subject of a security for the unpaid tax specified in the notification….”
For the purpose of this section— “property” means land or building, aircraft, ship, motor vehicle, or any other property which the Commissioner may deem sufficient to serve as security for unpaid taxes….”

A tax refund is a reimbursement of excess tax paid in a given period. Upon filling an individual income tax return, a tax refund may arise from;

Insurance policies on life and education that have not been granted relief by the employer on the same,
Having a mortgage from a specific financial institution (as listed on the 4th schedule on Income Tax Act), and has not been granted relief by the employer on the same,
A resident individual who was not granted personal relief during the year,
If tax deducted at source was paid in excess of final liability.
Taxpayers can apply for tax refund within five years from the date in which tax was paid through https://itax.kra.go.ke/KRA-Portal/.

The Voluntary Tax Disclosure Programme (VTDP) shall commence on 1st January 2021 and run for three years to 31st December 2023.
