Canada plans to reduce the number of temporary residents to 5% of the population, down from the current 6.2%.

As of 2024, the minister said there are a total of 2.5 million temporary residents in Canada. This is up from nearly one million in 2021, according to figures by national data collection agency Statistics Canada.

The country relies heavily on temporary foreign workers to fill labour shortages, Mr Miller noted, but said "changes are needed to make the system more efficient".

It also has international obligations to let in those who are fleeing war and political prosecution.

As part of the new policy, officials said some Canadian businesses will have to reduce the number of temporary foreign workers they rely on by 1 May, and will have a shorter window to prove that these jobs could not be filled by a permanent resident or a Canadian citizen.

Two exceptions to the rule will be workers in the construction and healthcare sectors - both of which are facing labour shortages in Canada. These workers will be allowed to enter the country at current levels until at least 31 August.

According to Statistics Canada, a majority of temporary residents - around 54% - in 2021 had a work permit. International students with a permit solely to study in Canada represented 22% of temporary residents, and asylum claimants accounted for 15%.

Others had a combination of permits, or are family members of temporary residents.

Candidates with a CRS score that is too low for a general draw may still have a chance at getting an Express Entry ITA if they are eligible for category-based selection.

The minimum CRS score required to receive an ITA changes in each Express Entry draw and can be influenced by the type of draw (general, program-specific, or category-based). CRS scores have shown some wide variation throughout Express Entry draws in 2024. As of March 12, there have been ten Express Entry draws.

Six of the draws were general, meaning candidates were considered from all Express Entry programs and categories. Scores for the general draws ranged from 525 to 541. The remaining four draws this year were for candidates who were eligible through category-based selection.

CRS scores for these draws have typically been lower than general draws, ranging from 336 to 437, depending on the category. Category-based selection draws were introduced in May 2023 as a means for IRCC to target Express Entry candidates who possess specific in-demand attributes. Five of the six categories are occupation-based for:
- Healthcare occupations
- Science, technology, engineering, and mathematics (STEM) professions
- Trades occupations, such as carpenters, plumbers, and contractors
- Transport occupations
- Agriculture and agri-food occupations

The remaining category is for Express Entry candidates with strong French language proficiency.

Candidates in this category saw the lowest score of the year so far (336) in a February 29 draw for 2,500 candidates. Another draw in the same category on February 1 was comparable at 7,000 ITAs issued to those with a CRS of 365.

Starting today, international students studying in master's programs that are less than two years in length, are eligible for a three-year post-graduation work permit (PGWP).

Before today, the length of an issued PGWP was correlated with the length of a program of study. However, in recognition that master’s students are placed to perform well in Canada’s labour market, Immigration Refugees and Citizenship Canada (IRCC) has chosen to expand the eligibility for these students to receive longer work permits.

The length of issued PGWPs for students in programs of study other than at the master’s level will continue to correspond with the length of study program, to a maximum of three years

Students in programs at PGWP-eligible designated learning institutions (DLIs)—the only schools in Canada authorised to accept international students—that are at least two years in length are also eligible for a longer, three-year PGWP.

In the weeks ahead, IRCC will also amend rules for spousal work permits for international students at an undergraduate level. This means only spouses of students at the master’s and doctoral level will be eligible to receive a spousal work permit. This change will not have any impact on spousal open work permits for the spouses or conjugal partners of Canadian citizens or permanent residents.

Immigration Minister Marc Miller announced Monday that the federal government will cap the number of student permits over the next two years. The government says it will approve approximately 360,000 undergraduate study permits for 2024 — a 35 per cent reduction from 2023.

Each province and territory will be allotted a portion of the total, distributed according to population. In some provinces, Miller said, the total reduction in permits will be approximately 50 per cent.

Provinces and territories will be left to decide how permits are distributed among universities and colleges in their jurisdictions. The cap will be in place for two years; the number of permits to be issued in 2025 will be reassessed at the end of this year.

Miller said that by imposing the cap, the federal government is taking action against some small private colleges.

In addition to the cap, the federal government will also require international students applying for a permit to provide an attestation letter from a province or territory.

Miller also announced changes to the post-graduation work permit program. Starting in September, international students who begin a program that's part of a curriculum licensing arrangement (one where a private college has been licensed to deliver the curriculum of an associated public college) will no longer be eligible for a post-graduation work permit.

Graduates of master's and other "short graduate-level programs" will "soon" be able to apply for a three-year work permit, the government says. Open work permits will also be made available to the spouses of international students in master's and doctoral programs.

More employers in Canada are now eligible to apply for the Recognized Employer Pilot Program (REP).

REP is designed to facilitate faster processing for Canadian employers who have shown to be compliant with the Temporary Foreign Worker Program (TFWP). Under the REP, qualifying employers will benefit from Labour Market Impact Assessments (LMIAs) with longer validity periods, and, after the initial assessment, simplified LMIA applications.

An employer may be eligible to participate in the REP if they have obtained at least three positive LMIAs over the past five years and are hiring Temporary Foreign Workers (TFWs) for positions on the list of occupations designated as being ‘in-shortage’ according to data from the Canadian Occupations Projection System (COPS).

Generally, LMIA work permit applications are valid for 18 months, but those eligible for the REP will receive LMIAs valid for up to 36 months. Employers will also have the advantage of simplified LMIA applications in future.

The first phase of the REP was rolled out in September 2023 for employers hiring employees in the primary agriculture sector. It included just four occupations:
- Livestock labourers
- Harvesting labourers
-Specialized livestock workers and farm machinery operators
- Nursery and greenhouse labourers

Phase 2 is a significant expansion with more than 80 in-demand occupations from a wide range of sectors now eligible for the REP.

Express Entry candidates in this situation have a few options to stay in Canada while waiting for a final decision on their application from IRCC. However, they may still require that a candidate stop working while they wait to receive an ITA and while they wait for IRCC to process their application.

Visitor Record: You may stay in Canada if you apply for a visitor record at least 30 days before your PGWP expires. IRCC says a visitor record is typically valid for six months, but this may vary from case to case.

Apply for another work permit:
Candidates can also apply for a new work permit while waiting for an Express Entry draw. Although it takes time and is an additional cost, those who wish to keep working can explore their options for a different type of Open Work Permit.

Candidates can also consider asking their employer to obtain a Labour Market Impact Assessment (LMIA) so they can get a closed work permit. This means the permit holder will be eligible to continue working in Canada, although they may not work for another employer.

If you already submitted a PR application: If you have already submitted your application for permanent residence but have not received a final decision from IRCC, you may be eligible to apply for a Bridging Open Work Permit (BOWP)

BOWPs allow a PR candidate to continue working in Canada while they wait for IRCC’s final decision. It applies to those who have applied through economic immigration programs such as those under Express Entry, the Provincial Nominee Program (PNP), Quebec Skilled Workers or the Agri-Food Pilot Program.

IRCC has announced temporary immigration measures to support family members of Canadians and permanent residents currently in Israel, the West Bank and Gaza, as well as Israelis and Palestinians already in Canada.

One measure includes the introduction of fee exempt study or open work permits in Canada. To be eligible, the foreign national must be a family member of a Canadian citizen or permanent resident who has left Israel and the Palestinian Territories, either with their family members or of their own accord since the beginning of the current regional conflict.

Israelis and Palestinians already in Canada who feel unsafe returning to the region may also be eligible for the permits. Eligible individuals must have valid temporary resident status to apply.

IRCC will also be prioritizing existing permanent residency applications for Palestinians within family-based streams (family class sponsorship).

Eligible applicants under this measure include the spouse, common-law partner, child (regardless of age), grandchild, sibling, parent, or grandparent of a Canadian or permanent resident, as well as their immediate family members.

The department says more details on the measures will be made available soon. In the meantime, IRCC has created a dedicated service channel for questions about on these special measures available for clients both in Canada and abroad at 613-321-4243, with collect calls accepted.

IRCC notes that clients can also check online and add the keyword “MOME2023” to the IRCC crisis web form with their enquiry and it will be prioritized.

Further, Permanent residents and family members of permanent residents and Canadian citizens may be eligible to apply online for time-limited medical coverage under the Interim Federal Health Program to support immediate medical needs upon arrival.

Ottawa is preparing to create a path to citizenship for hundreds of thousands of people who have lived and worked in Canada illegally for years, starting with construction workers, Immigration Minister Marc Miller says.

In an interview, Mr. Miller said he is preparing to create a “broad and comprehensive program” that would allow many without valid documents to apply for permanent residency. Among those included would be people who entered the country legally, as temporary workers or international students, and then remained here after their visas expired.

The minister said he plans to present a proposal to cabinet in the spring on allowing undocumented immigrants to “regularize their status.” But he acknowledged the policy may face opposition.

There are an estimated 300,000 to 600,000 people living in the country without valid documents, he added. Many have been working here for decades and have children, but risk deportation because they lack formal status.

Immigration, Refugees and Citizenship Canada has been considering creating a program for undocumented workers since shortly after the last election. Prime Minister Justin Trudeau’s mandate letter to former immigration minister Sean Fraser in 2021 asked him to “further explore ways of regularizing status for undocumented workers who are contributing to Canadian communities.”

Mr. Miller suggested that not all those without valid documents would be allowed to apply for permanent residency, including those who have arrived recently in Canada.

But he said he is planning in the near future to roll out a program that would allow construction workers living in Canada without legal status to apply for residency, to help address Canada’s shortage of skilled workers able to build homes.

- Starting on January 1st, the cost-of-living requirement for a single study permit applicant will be $20,635. This is in addition to the first year of tuition and travel costs and will apply to study permit applications received on or after January 1st. The new cost is more than double the current requirement of $10,000, an amount brought in during the early 2000s that has not been adjusted since.The department also notes that the new financial guidelines will be applied to the Student Direct Stream (SDS).

- The waiver on the 20-hour-per-week limit on the number of hours international students are allowed to work off campus while class is in session will be extended to April 30, 2024. International students already in Canada, as well as applicants who have already submitted an application for a study permit as of December 7, 2023, will be able to work off campus more than 20 hours per week until that time.

- The facilitative measure that has allowed international students to count time spent studying online towards the length of a future post-graduation work permit, as long as it constitutes less than 50% of the program of study, will continue to be in place for students who begin a study program before September 1, 2024. This measure will no longer apply to students who begin a study program on or after that date.

- A temporary policy was introduced on 3 occasions to provide an additional 18-month work permit to post-graduation work permit holders as their initial work permit was expiring. Foreign nationals with a post-graduation work permit expiring up to December 31, 2023, remain eligible to apply. However, this temporary policy will not be extended further.

IRCC issued 4,750 invitations to apply (ITAs) in an all-program draw. Candidates required a minimum Comprehensive Ranking System (CRS) score of 561 to be considered.

This is the first draw since October 26. On November 14 IRCC tweeted that some applicants were experiencing issues using the Express Entry Profile Builder and are unable to submit their application.

On November 16, the department followed up with a tweet saying the issue has been resolved. It's unclear it was the reason for the extended gap in draws.
