Fatal Acciden? What Happens Next, and Why the Right Motor Insurance Matters

It is a quiet Sunday afternoon.

You are driving along Waiyaki Way, somewhere around Nairobi School. Traffic is not too heavy. The road feels normal. You are thinking about where you are going, maybe home, maybe to visit someone, maybe just running a small errand before Monday begins.

Then, in one sudden moment, everything changes.
A student tries to cross the road.
You see them too late.
You hit the brakes hard. Your heart jumps. The car stops, but not soon enough.
You have hit the student.
For a few seconds, your mind goes blank.

You step out of the car shaking. People start gathering. A few boda boda riders stop. Other motorists slow down. Someone is shouting. Someone else is telling you not to move the car. Another person is asking if the student is breathing.

You bend down, terrified, confused, praying silently that the student survives.

Someone suggests calling an ambulance. Someone else says an Uber will be faster. In the panic, people help get the student into a vehicle and rush them to a hospital in Westlands.

You remain at the scene.

Your hands are shaking. Your car is there. The crowd is growing. You are scared of the police. You are scared of the crowd. You are scared of the child’s parents. You are scared of what this means for your life.

A short while later, the worst news comes.
The student has been confirmed dead on arrival.
That is the moment a normal Sunday becomes a lifelong memory.
And now, beyond the pain, fear and shock, a serious legal, police and insurance process begins.

First Things First: Do Not Run Away
After a serious accident, especially one involving injury or loss of life, panic can push people into terrible decisions.

Do not run away from the scene unless your life is in immediate danger. If the crowd becomes hostile, move to safety and report to the nearest police station as soon as possible.

Running away can make things worse legally and emotionally. It may also complicate your insurance claim.

Stay calm as much as possible. Cooperate. Call for help. Call the police. Call your insurance intermediary.

In that moment, you need guidance. Not guesswork.

Step 1: Call Your Insurance Intermediary Immediately
One of the first calls you should make is to your insurance agent or broker.

This is where many motorists get stuck. They bought insurance, yes, but they don’t know what to do when an accident happens.

A good insurance intermediary will guide you on:
• What details to record
• What photos to take
• Which documents to preserve
• How to notify the insurer
• Whether towing is covered
• Whether your car repairs may be covered
• How the third-party death claim process may begin
• What not to admit or sign without understanding

Step 2: Secure Accident Scene Photos
Before the vehicle is moved, try to secure photos and videos of the scene, where possible and safe.

Take clear photos of:
• The position of your vehicle
• The road section
• Skid marks, if any
• Damage to the vehicle
• Road signs nearby
• Weather and road condition
• Any obstruction or visibility issue
• The surrounding traffic environment
• The point of impact, if identifiable

This is not about escaping responsibility. It is about preserving facts.

Accidents are investigated based on evidence. Later, people may say many things. Witnesses may differ. Emotions may rise. But photos taken at the scene can help reconstruct what happened.

Do not interfere with police work. Do not stage anything. Just preserve what is real.

Step 3: Cooperate With the Police
When police arrive, they will secure the scene, take initial statements, inspect the area and begin recording the accident.

In a fatal accident, the police process becomes serious.

Your car may be towed to a police station, in this case possibly Parklands Police Station, depending on where the accident occurred and police jurisdiction.

The vehicle may be held for inspection. This is normal in serious road accidents.

Do not argue unnecessarily. Do not try to “talk your way out” at the scene. Do not offer money. Do not make careless admissions like:

“It was fully my fault.”

You can express concern. You can cooperate. But let investigations establish the actual cause.

There may be many factors: speed, visibility, pedestrian crossing point, sudden movement, road conditions, driver reaction, vehicle condition, braking distance and witness accounts.

Step 4: Get Police Bond or Cash Bail Where Applicable
Depending on the circumstances, police may require you to remain available for investigations. You may be released on police bond or cash bail as investigations continue.

This part is frightening for many motorists because they do not understand what is happening.

A police bond or cash bail does not automatically mean you have been convicted. It means police want to ensure you will return when required.

You may need legal support at this stage, especially because the accident involved loss of life. Where necessary, speak to a qualified advocate.

Insurance helps with claims, but criminal responsibility and court processes require legal guidance.

Step 5: Leave the Vehicle for Inspection
In a fatal accident, the vehicle will often be inspected before release.

The inspection may look at issues such as:
• Brake condition
• Tyres
• Lights
• Steering
• General mechanical condition
• Visible damage
• Whether the vehicle was roadworthy

This matters because the cause of accident must be investigated. If mechanical failure is suspected, that becomes part of the record.

Do not rush to repair the car before inspection and insurer assessment. If the car is comprehensively insured, the insurer will usually need to assess the damage before repairs are authorized.

Step 6: Confirm Whether Your Insurance Was Valid
This is the part many motorists fear silently.
1. Was your insurance valid on the date and time of the accident?
2. Was the vehicle insured under the correct class?
3. Was the premium properly paid?
4. Was the certificate genuine?
5. Was the vehicle being used according to the policy?

For example, if the car was insured as private but was being used as a taxi, chauffeur vehicle, school transport or commercial passenger vehicle, the claim may become complicated.

Step 7: Get the Police Abstract
After reporting and recording the accident, you will need to follow up for a police abstract.

The police abstract is one of the key documents in an insurance claim. It confirms that the accident was reported and gives official details captured by the police.

Your insurer may require the abstract before processing certain parts of the claim.

Other documents may also be requested, depending on the claim type.

The Three Main Claims in This Situation

1. Motor Vehicle Repairs
If your vehicle is comprehensively insured, the damage to your own car may be covered, subject to policy terms, excess and assessment.

This may include damage to the front bumper, bonnet, lights, windscreen or other affected parts depending on the impact.

If you only had Third Party Only insurance, your own vehicle repairs are usually not covered.

This is one of the biggest differences between Third Party and Comprehensive motor insurance.

Third Party may keep you legal.
Comprehensive protects much more.

2. Third-Party Loss of Life Claim
This is the most serious part of the claim.

Because the accident involved a pedestrian who later passed away, there may be a third-party death claim against your motor insurance policy.

The deceased person’s family or legal representatives may pursue compensation through the relevant legal and insurance process.

The insurer will need documentation, police records, legal documents and other supporting evidence.

This process can take time. It can involve advocates, investigators, court processes, negotiations and formal claim review.

This is why valid insurance is extremely important. Without proper insurance, the financial burden can fall heavily on the vehicle owner or driver.

3. Towing Claim
If your vehicle was towed from the accident scene to the police station, there may be towing costs.

Whether towing is covered depends on your policy terms and whether you have towing or roadside assistance benefits under your cover.

Some comprehensive motor policies may include towing up to certain limits. Others may require additional benefits or approval.

Always ask your insurance intermediary what towing support is available under your policy before you need it.

What You Should Not Do After Such an Accident
In panic, many people make mistakes that later hurt them.
Avoid the following:
1. Do not run away from the scene unless your safety is at risk.
2. Do not admit full liability before investigations are complete.

7. Do not assume your certificate means everything is covered.
