My article, “Drafting Effective Arbitration Clauses for Cross-Border Contracts Involving Central Asia: Practical Considerations,” has been published in the September 2026 issue of Right and Duty+.
The article examines practical choices in drafting arbitration clauses for contracts involving Central Asia: scope of disputes, seat of arbitration, institution, language, applicable law and appointment of arbitrators.
A central point is the importance of adapting the clause to the transaction and the relevant legal context. Wording borrowed from another contract may leave questions that only become apparent when a dispute arises.
