The Sunrise Period of domain registration is a special period during which trademark or brand right holders may preregister domain to avoid cybersquatting. Types of Sunrise Periods:

End Date Sunrise: In this type the Registry can announce the Sunrise as late as the day the Sunrise starts, but must run the it for 60 days or more. All claims for domain should be submitted during that period and auction is conducted if there is more than one claim for the same domain.

Start Date Sunrise: In this type the Registry must give 30 days notice before commencing the Sunrise and must run it for only 30 days or more. Claims by trademark or brand owners are processed on a first-come-first-served basis, so there is no need for auctions.

In practice, the brand owners with registered trademarks outside that industry (45 classes are not applied for copyrighted works) have a limited opportunity to claim. Accordingly, having a copyright certificate as a proof for a brand increases a chance for domain preregistration.

A limitation period is the period of time within which a person can protect his violated right by filing a claim. If a person does not file a claim within the relevant time period stipulated by the law, there is a risk that that person might lose his/her right to pursue his/her claim. For certain types of claims, the legislation may establish special limitation periods, reduced or longer in comparison with the general period. Additionally, the limitation periods in each countries are different and might not be expressed in one comprehensive statute, but might be contained in multiple statutes.

With regard to intellectual property, the limitation period does not apply to claims for the protection of moral rights and other intangible benefits.

The exclusive right to the result of intellectual activity created by one of the spouses does not belong to the common property of the spouses and is not subject to division upon divorce, but the financial benefits (royalties, sale, etc.) received from this result of intellectual activity are the common property of the spouses. Based on this, when the property is divided, the exclusive right to the result remains with the author-copyright holder, and his/her spouse has the right to claim half of the income received from the commercialization of the results of intellectual activity.
