Understanding the Contractor's Master Programme in Construction Projects.

The Contractor’s Master Programme is the overall roadmap for delivering a construction project within the required time, cost, and contractual constraints. It establishes the sequence and duration of activities, key milestones, dependencies, resources, and the critical path. It provides the project team with a clear plan of how the works should progress from commencement through to completion.

The programme is also an important project control and contractual management tool. It provides a baseline for comparing planned and actual progress, identifying delays, monitoring productivity, coordinating resources, and taking corrective actions. Regular updates are essential because construction activities, resources, design information, procurement, and site conditions can change throughout the project.

From a contractual and claims perspective, a properly prepared and regularly updated programme can provide valuable evidence when assessing delays, disruption, and Extension of Time (EOT) entitlement. It helps establish the planned completion date, identify the causes and effects of delays, and analyse their impact on the critical path. Therefore, the Master Programme is not simply a scheduling document; it is a key tool connecting planning, project control, cost management, risk management, and contractual administration.

Unpacking Exceptional Events: Force Majeure in the FIDIC 2017 Red Book

Are you navigating the complexities of Force Majeure in international construction? In this video, we dive deep into how the FIDIC 2017 Red Book modernized the treatment of unforeseen disruptions by replacing the traditional "Force Majeure" terminology with "Exceptional Events" under Clause 18.

We explore the practical and legal implications of this shift, including:
*The Foreseeability Test:* Discover how FIDIC focuses on whether an event is beyond a party's control and if its effects could be avoided, rather than strictly looking at whether it was foreseeable at the time of contracting.

*The Prevention Threshold:* Learn why an event must completely prevent performance to qualify. We discuss why economic hardship, market disruptions, or making the work more costly does not normally qualify as an Exceptional Event under the strict FIDIC framework.

● Risk Allocation & Commercial Imbalance:** Understand the harsh realities for contractors who bear the immediate operational consequences (like idle labor and disrupted cash flow). While you may be entitled to an extension of time, full recovery of additional costs is rarely guaranteed.
