The legal fraternity in Lesotho is nearing complete disaster. So much for a profession once known and touted as the noble profession. Systematic problems that that span many years have rendered the delivery of justice a far fetched and forlon hope for many basotho. This include inadequate resourcing for the judiciary but of late it is also the calibre of practitioners who are a serious concern. Although there is a body that regulates practitioners, it is seemingly toothless and/or has been mostly ineffective over the years. I am not sure if lawyers are taught ethical course during that training because what we are seeing in practice points to not only lack of ethics but also moral bankruptcy.
The back log of cases in all the courts structures is a serious concern that gets worse each year with none of the political authorities committed to solve it in earnest. Instead, political authorities have meddled in judicial appointments improperly over the years and that has left the judiciary appearing to be captured in the eyes of certain sections of the public. We will one day lose all hope for the credibility of the whole system and become a failed state unless something drastic is done.

Relationships are built on trust, especially in the non-profit space. Relationships between grantors and the organization, between associations and their membership, and between organizational leadership and the board of directors must be built on trust. Unfortunately, employees, agents and stakeholders of those organizations sometimes abuse that trust. As fraudsters become more brazen and more difficult to detect, organizations of all sizes and in all industries face varying degrees of occupational fraud risk.

Unfortunately, organizations are often at a more acute risk, because of limited resources and a lack of experience identifying and addressing potential areas of concern. The good news, however, is that organizations have opportunities to implement more effective processes and controls to limit fraud risks.

What is an Ethical Dilemma?
An ethical dilemma (ethical paradox or moral dilemma) is a problem in the decision-making process between two possible options, neither of which is absolutely acceptable from an ethical perspective. Although we face many ethical and moral problems in our lives, most of them come with relatively straightforward solutions.
On the other hand, ethical dilemmas are extremely complicated challenges that cannot be easily solved. Therefore, the ability to find the optimal solution in such situations is critical to everyone.
Every person may encounter an ethical dilemma in almost every aspect of their life, including personal, social, and professional.

How to Solve an Ethical Dilemma?
The biggest challenge of an ethical dilemma is that it does not offer an obvious solution that would comply with ethics al norms. Throughout the history of humanity, people have faced such dilemmas, and philosophers aimed and worked to find solutions to them.
The following approaches to solve an ethical dilemma were deduced:
• Refute the paradox (dilemma): The situation must be carefully analyzed. In some cases, the existence of the dilemma can be logically refuted.
• Value theory approach: Choose the alternative that offers the greater good or the lesser evil.
• Find alternative solutions: In some cases, the problem can be reconsidered, and new alternative solutions may arise.

Examples
Some examples of ethical dilemma examples include:
• Taking credit for others’ work
• Offering a client a worse product for your own profit
• Utilizing inside knowledge for your own profit

Ethical Dilemmas in Business
Ethical dilemmas are especially significant in professional life, as they frequently occur in the workplace. Some companies and professional organizations (e.g., CFA) adhere to their own codes of conduct and ethical standards. Violation of the standards may lead to disciplinary sanctions.
Almost every aspect of business can become a possible ground for ethical dilemmas. It may include relationships with co-workers, management, clients, and business partners.
People’s inability to determine the optimal solution to such dilemmas in a professional setting may result in serious consequences for businesses and organizations. The situation may be common in companies that value results the most.
In order to solve ethical problems, companies and organizations should develop strict ethical standards for their employees. Every company must demonstrate its concerns regarding the ethical norms within the organization. In addition, companies may provide ethical training for their employees.

Of late I have noticed Service Providers trying all survival tricks during these COVID-19 challenges. I am going to make an example with Insurance companies who preach means and ways for their policy holders to make sure they meet their premium payments despite COVID-19 ie pay with MPESA etc but are saying absolutely nothing in terms of what measures are they putting in place to ensure their customers also get their pay out/claims despite the COVID-19 situation should they need to claim!

You might have landed on this page, thinking and/or assuming that it costs a lot of money, time, and personnel resources to implement a robust fraud prevention program in your organization.
But that’s not necessarily true. For most organizations, fraud prevention and detection tools can be easily implemented, rarely equate to the hiring of another individual, and don’t usually equate to much more of your time or resources.
When considering fraud prevention and detection tools, it is important to understand that one size does not fit all. And, as an organization expands or contracts, these tools (or processes and procedures), need to be reconsidered to ensure they continue to meet your goals and objectives.
Segregation of duties and internal controls work best when employees understand the importance of their roles, and that implementation of these strategies are not due to their untrustworthiness, but rather because we want to keep your assets safe and your employees safe in their jobs. We will explore these prevention strategies in more detail.

The recent judgement in South Africa against Public Protector where she was found to have lied under oath and misrepresented various aspects in her discharge of an investigation involving ABSA and the SARB and was as a result found personally liable for 15% of the litigation costs involved should serve as a deterrence against public officials to properly discharge their duties knowing that there are consequences should they fail. It is a landmark judgement which could do a lot of good if applied in Lesotho where there is so much sloppiness by people in authority.
